Decision:

Rule 869 (2) (a):  Following the running of race 8 the Stipendiary Stewards lodged an information alleging that Mr Dunn the driver of Majhac Meddle used his whip excessively in the run home.

At the outset of the hearing the Committee noted that Mr Dunn admitted the breach but wished to be present. Mr Dunn at the hearing was assisted by Senior Horseman Mr C Thornley.

The breach is accordingly found proven.

The Stipendiary Stewards showed the video evidence of the last 200 metres and told the Committee that Mr Dunn in their view had used the whip in a continuous manner  at least 21 times over that distance.

Mr McIntyre also advised the Committee that Mr Dunn had been found guilty of beach of the rule on 8 June 2008 and had been fined $200.00. Mr McIntyre further submitted that as this was a listed race and sought a fine to reflect that.

Mr Thornley said that Mr Dunn drove extensively and had a significant number of drives since the last offence. Mr McIntyre said that in his view Mr Dunn had had 250 drives since the last offence under this rule.

The Committee after giving consideration to both parties  submissions agrees that a monetary penalty only is appropriate and imposes a fine of $350.00 to reflect  the race in which the offence occurred and to give some discount to Mr Dunn for his previous record.
