Following the running of race 8 the Stipendiary Stewards lodged an information alleging a breach of rule 869 (2) (a) and that Mr Markham the driver of Kipp Ross used his whip excessively in the run home.

The charge is accordingly found proven.

The Stipendiary Stewards submitted that in the last 200 metres Mr Markham had used the whip on his horse continuously at least 21 or 22 times

Mr Markham for his part said that he had counted 24 and had used the whip in such a manner as he was intent on winning the race and the connections of the horse expected it to be driven out.

Mr McIntyre said that Mr Markham had no similar charges over the last 12 months but asked the Committee to take into account that the race was a listed race and sought a monetary penalty only.
