Following the running of race 6 an information was lodged by the Stipendiary Stewards alleging that Mr Shand breached rule 869 (3) (b) in that with approximately 700 meters to run he drove carelessly when permitting his horse, Eastwood Jaunty to move in checking Glossy [A M Butt] resulting in that horse breaking and losing all chance.

At the outset of the hearing Mr Shand confirmed his written guilty plea. The Stipendiary Stewards demonstrated the incident with the assistance with the video evidence.?

With regard to penalty the Stipendiary Stewards asked the Committee to take into account that Glossy who was reasonably well favoured on the tote broke and lost all chance as a result of the interference and submitted that a suspension was appropriate.

Mr Shand for his part indicated that he was unlikely to have very many drives, if any, over the next three to four weeks, as Eastwood Jaunty was the only horse he was driving and it would not be racing during that period. Mr Escott said that there were meetings in January where the horse would be eligible to start and sought a suspension until the completion of those race dates.

The Committee, after giving consideration, to Mr Shand's early guilty plea, his frankness at the hearing, his driving record and his acceptance that suspension was the appropriate penalty suspends Mr Shand licence to drive from the completion of racing today until completion of racing on the 31st January 2005.
