| ---- DECISION & REASON ----Following the running of Race 5 the Stipendiary Stewards lodged information against C Markham [Mycool Warker] alleging that he used the whip accessibly on his horse on the run home. ----At the outset of the Hearing Mr Markham confirmed that he admitted the breach and accordingly the charge is found proven. ----Mrs K. Williams demonstrated the incident with the assistance of the video evidence and stated that in her counting Mr Markham used the whip continuously over approximately 300 metres striking the horse at least 27 times. Mr Markham for his part accepted what Mrs Williams said. ----With regard to the penalty, the Stipendiary Stewards recommended that the standard fine be imposed and Mr Markham accepted that recommendation. The Committee arriving at its decision as to penalty, took into account first Mr Markham's early guilty plea and secondly the clear record he had in respect of breaches of the Rule over the last 12 months. ----Accordingly the penalty of $200.00 is imposed. --
