Decision:

Following the running of Race 1, R & R Haulage Trot, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Horseman, Mr M R Tapper, alleging a breach of Rule 869 (2) (a) in that, as the driver of DISTRIBUTION in the Race, Mr Tapper “used his whip excessively throughout the run home”.

Following the running of Race 1, R & R Haulage Trot, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Horseman, Mr M R Tapper, alleging a breach of Rule 869 (2) (a) in that, as the driver of DISTRIBUTION in the Race, Mr Tapper “used his whip excessively throughout the run home”.

Mr Tapper had signed the Statement by the Defendant on the information form indicating that the breach was admitted and that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Rule 869 provides as follows:
(2) No horseman shall during any race:-
 (a)   use his whip in an unnecessary, excessive or improper manner.

Mrs Williams, Stipendiary Steward, showed a video replay of the final 400 metres of the Race, from just prior to the home turn. She pointed out Mr Tapper on DISTRIBUTION racing outside the leader at that stage. She alleged that, from that point, Mr Tapper used the whip approximately 21 times. The Committee noted that DISTRIBUTION finished in 6th placing.

Mrs Williams informed the Committee that Mr Tapper had breached the same Rule in March of 2009 and had been fined $200 on that occasion. She recommended a suspension of between 2-3 weeks.

--

In determining penalty, the Committee took into account Mr Tapper’s admission of the breach and the previous breach of the Rule. The present breach was, in the Committee’s view, mid-range in terms of seriousness.

--

Mr Tapper’s Open Horseman’s licence was suspended from the conclusion of the day’s racing up to and including Friday, 30 October 2009.
