FACTS:

--

Following the running of Race 8, PGG Wrightson Limited Handicap Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Driver, Mr C J De Filippi, alleging a breach of Rule 507A in that, as the driver of LIFE’S DECISION in the race, he “was late to take his drive – 5 minutes to start time”.

Mr De Filippi had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be   present at the hearing of the information

Rule 507A provides as follows:

--

Every horseman shall be available to take their engagement to drive a horse at least fifteen minutes prior to the race start time, except when otherwise directed by a Stipendiary Steward.

--

SUBMISSION(S):

--

Mr McIntyre said that, prior to Race 8, Mr De Filippi, who had been engaged to drive LIFE’S DECISION in that race, had been changed and ready to leave the course. His explanation to the Stewards was that he had forgotten the engagement. As a result, the horse was taken on to the track only some 4-5 minutes before the start. That was unacceptable, Mr McIntyre said. One saving feature was that horses were only being given short preliminaries because of the inclement weather conditions, Mr McIntyre said.

The Committee was satisfied that Mr De Filippi had committed a breach of the Rule.  The Committee also noted Mr De Filippi’s admission of the breach.

Mr McIntyre referred to the Penalty Guide which recommended a fine of $100 for a breach of the Rule.

In determining penalty, the Committee took into account Mr De Filippi’s admission of the breach and the penalty recommended by the Penalty Guide, as referred to by Mr McIntyre.
