Decision: --

Following race 8 a protest was lodged pursuant to Rule 876(1) when it was alleged that COOL TALK placed second by the Judge interfered with the chances of LA STRADA placed fourth by the Judge.

----------

DECISION & REASON:

--

Following race 8 a protest was lodged pursuant to Rule 876(1) when it was alleged that COOL TALK placed second by the Judge interfered with the chances of LA STRADA placed fourth by the Judge. The interference was alleged to have occurred in the final straight. The margin between third and fourth was a neck.

--

--

Mr Coles demonstrated both films which showed COOL TALK coming into the straight wide and then embarked on an angled run inwards finally coming into contact with LA STRADA causing interference. Mr Coles stated that LA STRADA?S chances of finishing in a better placing were affected.

--

--

Mr A Calder, rider of LA STRADA, confirmed Mr Coles' observations and said that as a result of the interference he had to stop riding and his mount lost momentum at an important stage. He said the interference cost him at least third placing.

--

--

Mr O?Sullivan accepted that there was brief interference but that the third placed horse CHAMPAGNE HEIGHTS was travelling better than LA STRADA.

--

--

We prefer the informant's evidence

--
--

We find that interference took place and it affected the chances of LA STRADA gaining a better place given that the margin between third and fourth was a neck. Accordingly the protest is upheld. The amended placings are: 13, 10, 3, 9.
