Following race 3 an information was filed pursuant to Rule 876(1) when it was alleged by Mr J Oatham, Stipendiary Steward, that GRACE placed first by the Judge interfered with the chances of TUWANDA placed second by the Judge.

Following race 3 an information was filed pursuant to Rule 876(1) when it was alleged by Mr J Oatham, Stipendiary Steward, that GRACE placed first by the Judge interfered with the chances of TUWANDA placed second by the Judge. This interference was alleged to have occurred in the home straight. The margin between first and second was a short head.

Connections of both horses were asked if all parties were informed of the inquiry, which they confirmed.

Mr Coles, Stipendiary Steward, demonstrated the video films and showed where GRACE ridden by V Colgan moved out quite sharply and took the line of TUWANDA ridden by C Lammas. He said at this stage TUWANDA was ? to a length behind GRACE and then finished on strongly.

Mr Griffiths, owner/trainer of TUWANDA, said his horse was a big strider and believed his winning chances were affected, particularly in the heavy ground.

Mr Lammas, rider of TUWANDA, confirmed what Mr Griffiths had said.

--

Mr Colgan, rider of GRACE, pointed out on the film TUWANDA moving in but also admitted moving out himself. He considered both horses contributed to the interference.

Mr Pike, trainer of GRACE, agreed with Mr Colgan's evidence and also added that in his opinion Mr Lammas did not stop riding at any stage.

Mr Oatham summed up by saying Mr Colgan moved out 1? to 2 horse widths which caused Mr Lammas to redirect the line of his mount. He reminded the Committee of the margins at the line.

The Committee carefully considered all evidence and repeated viewing the video films. We were satisfied that interference did take place when GRACE moved out sharply into the line of TUWANDA. We believe this movement did affect the chances of TUWANDA finishing in a better place as Mr Lammas did have to change his line to the post.

In applying our discretion we have taken the above into account and also considered the short head margin at the line, and the strong manner in which TUWANDA finished the race compelling reasons to uphold the protest. Accordingly the protest is upheld and the Judge's placings shall now be:
