Decision:

Under the provisions of Rule 632 (2) the Committee declared ITS SO EASY and BLINDSPOTT to have been starters and confirmed their respective 3rd and 4th placings in the race.

Facts:

Following the running of Race 5, Thompson Family 1100, Stipendiary Steward, Mr A Coles, lodged an Information with the Judicial Committee. He requested a ruling pursuant to Rule 632 (2) to determine whether ITS SO EASY and BLINDSPOTT gained any advantage after their respective gates opened slightly early.

Rule 632(2) states "If, in the opinion of the Judicial Committee, any horse gained an unfair advantage by its barrier stall malfunctioning and opening, or being forced, by such horse, open prior to the starter effecting a start, such horse may be declared a non-starter".

Submissions for Decision:

Mr Coles demonstrated the incident using the available video footage. He submitted it was clear that both gates opened fractionally early. However, the Stewards were of the view that both horses did not gain any advantage.

Mr Colgan, the rider of BLINDSPOTT, said that his gate opened slightly early. He said his mount jumped in the air and lost any advantage that may have been gained.

Ms Fawcett, the rider of IT’S SO EASY, said her gate opened fractionally early. She said her mount jumped away awkwardly.

Mr Williamson advised the Committee that the Starter had informed him that there was a short circuit malfunction when the start was effected and as a result two gates opened slightly early.

Reasons for Decision:

The Committee considered the submissions presented and reviewed the video footage.

The head on video footage showed that the barrier stalls of both ITS SO EASY and BLINDSPOTT opened marginally ahead of all the others. As a result it was clear that ITS SO EASY began awkwardly and briefly unbalanced its rider. It was clear that BLINDSPOTT jumped in the air when the gates opened and any advantage that may have been gained was negated.

In summary there was no video evidence to suggest that ITS SO EASY or BLINDSPOTT gained an unfair advantage.
