As Mr Oliver admitted the breach the Committee finds the charge proved.

Penalty:

The Committee grant Mr Oliver’s request to seek a deferment to his suspension as per Rule 1106(2).

Accordingly, the Committee imposes a suspension on Mr Oliver which will commence after racing on 7 June and conclude after racing on 18 June 2014 (6 North Island days).

Facts:

Following the running of race 4, Murray Wilcox Limited 1200, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that Mr Oliver permitted his mount DASHA to shift in shortly after the start when not sufficiently clear, dictating GEMODI inwards crowding PATAKIA onto the hind quarters of MESKERRE with PATAKIA being checked.

Mr Oliver acknowledged that he understood the nature of the charge, the Rule and admitted the breach. Mr Oliver was assisted at the hearing by Mr McKeagg.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Coles identified on the video films that Mr Oliver permitted his mount to shift in shortly after the start when only ¾ of a length clear of GEMODI. He said this resulted in PATAKIA being crowded with her hind quarters making contact with MESKERRE. Mr Wong the rider of MESKERRE had to take a hold of his mount and MARY POPPINS was also inconvenienced.

Mr McKeagg told the Committee that after viewing the films he stated Mr Oliver was not as careful as he should have been. He said Mr Oliver was at a loose end previously but is now in a stable environment working for him. Mr McKeagg said he expected this type of charge “won’t happen again.”

Mr Oliver told the Committee it was clear on the video films that he shifted in too quickly after the start which resulted in several horses being checked.

Mr Oatham produced Mr Oliver’s record which showed 3 previous breaches under this Rule in the last 12 months.

Mr Oatham said this was Mr Oliver’s 4th suspension since September 2013 which is of some concern to the Stewards. He said Mr Oliver was still early in his career and stated he had 223 raceday rides. He said Mr Oliver did shift in sharply which resulted in a number of runners being affected. Mr Oatham said the level of carelessness was low end and submitted a penalty at the low end of scale.

Mr Oliver advised that he had upcoming commitments at Te Rapa on 7 June, and any proposed suspension could commence after that.

Mr Oliver confirmed that he rode only in the North Island.

Mr McKeagg asked the Committee to take into account Mr Oliver’s good behaviour.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The Committee have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating fact is Mr Oliver’s admission of the breach. The aggravating factors are Mr Oliver’s record under this Rule which is below average even having regard for the fact he is an apprentice rider, the level of carelessness is closer to mid – range than low because Mr Oliver shifted in when only ¾ of a length clear, this resulted in 3 other horses being checked to various degrees.

After taking into account all the above factors the Committee considers an appropriate penalty is a 6 day suspension.
