Facts:
Following the running of race 2, NZB Insurance Pearl Series Race, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Jones, alleged that Mr Prastiyou allowed his mount SILK to shift in when not clear crowding DETACH, CLASSIC DANCE and PLUMES VOLANTES with SAVY LADY being checked, also hampered was SOUL SERENADE passing the 1250 metres.
Mr Prastiyou acknowledged that he understood the Rule and confirmed his admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Coles identified that Mr Prastiyou allowed his mount to shift in when not the required distance clear. He showed that this resulted in crowding to DETACH, CLASSIC DANCE and PLUMES VOLANTES. He pointed out that SAVVY LADY was sharply checked and lost about 2 lengths and SOUL SERENADE was hampered adjacent to the running rail. Mr Coles said that Mr Prastiyou had misjudged the required distance clear when shifting in.
Mr Prastiyou said that he went to go forward and he didn’t realise that he had tightened up several runners to his inside when shifting in.
Submissions for Penalty:
Mr Jones produced Mr Prastiyou’s record which showed 2 previous breaches under this Rule in the last 12 months. He said the level of carelessness was in the mid-range given that a number of runners were interfered with. He said the worst affected runner was SAVVY LADY. He said Mr Prastiyou had a relatively good record and he should be given credit for his admission of the breach. Mr Jones submitted a suspension in the vicinity of 5 days would be appropriate.
Mr Prastiyou advised that he had engagements at Ellerslie on 3 June and any proposed suspension could start after that date.
In answer to a question from the Committee, Mr Prastiyou advised that he has no recent history of riding in the Central Districts or the South Island on Industry days.
Mr Jones confirmed this was correct.
Mr Prastiyou recognised that those date would not be included in his suspension.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. The Penalty Guide for Judicial Committees recommends that the starting point for careless riding is a 5 day suspension.
The aggravating factors were that 3 horses were initially crowded which in turn resulted in SAVVY LADY and SOUL SERENADE being checked losing several lengths. It was evident when reviewing the footage that SAVVY LADY was crowded inward making firm contact with the hindquarters of SOUL SERENADE which became unbalanced for a few strides. The Committee deemed the level of carelessness to be in the mid-range. These factors vindicate an uplift in penalty.
The mitigating factors were Mr Prastiyou’s admission of the breach and his good record which allow a reduction in penalty.
After taking into account all the above factors the Committee considered an appropriate suspension was 5 days.
