Facts:
Prior to race 3, Jimmy Choux Yearlings @ Karaka 2015, an Information was filed pursuant to Rule 330(3) (c). The Informant, Mr Oatham, alleged that Mr Bosson failed to make the weight for ALTAI ROSE.
Mr Bosson acknowledged that he understood the nature of the charge, the Rule and he admitted the breach.
Rule 330(3) (c) provides: A rider shall not fail to ride a horse at the weight at which it is handicapped to carry.
Mr Oatham advised the Committee that Mr Bosson had been engaged to ride ALTAI ROSE through his agent Mr Rodley. However at 11am this morning Mr Rodley advised the Stewards and Ms Guy, the trainer of ALTAI ROSE, that Mr Bosson was unable to make the contracted weight.
Mr Oatham during his investigation noted Ms Guy had contacted Mr Rodley on 2 August and he assured her Mr Bosson would make the weight. Mr Oatham added as a precaution Ms Guy accepted ALTAI ROSE for the Hastings race meeting on August 30.
Mr Oatham advised that Ms Guy elected to late scratch ALATAI ROSE because in the opinion of her connections there was no suitable replacement rider. The horse was reported to be a “difficult ride”.
Mr Bosson said he was unaware of the communication that occurred between Mr Rodley and Ms Guy the day prior to the races. Mr Bosson stated that he was aware before scratching time on race morning he would not make the contracted weight. He added that he sent his agent a texted message but didn’t hear back from him for a couple of hours.
In response to questions from the Committee, Mr Bosson said he struggles to lose weight in the colder months. Mr Bosson advised that he had left home at 3.30am yesterday to ride track work at Cambridge and then drove to the Te Teko trials. He said due to those commitments he was only able to spend an hour in the spa which was insufficient time to lose the required weight.

Mr Oatham produced Mr Bosson's record which showed 3 previous breaches under this Rule in the last 12 months.
13 January 2014 - $100 fine
1 March 2014 - $200 fine
8 March 2014 - $500 fine, failed to make the weight for 2 rides.
He described this record as “not a particularly good one” and acknowledged Mr Bosson does struggle with his weight. Mr Oatham submitted there were a number of aggravating features, the connections of ALTAI ROSE are based in Honk Kong and are very particular in their riders, the horse was late scratched at 12 o’clock which impacted on the Club and as a consequence of this ALTAI ROSE would have to be floated to Hastings to race this Saturday.
Mr Oatham was of the view that a minor infringement was not an appropriate penalty given the circumstances of this case.
Mr Oatham recommended to Mr Bosson that he and Mr Rodley needed to organise “what weight he can do”. He submitted a fine in the range of $300 to $500 would be an appropriate penalty.
Mr Bosson submitted that he had 10 trial rides yesterday and this prevented him from spending enough time in the spa. Mr Bosson acknowledged that a fine was an appropriate penalty.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. The Committee is satisfied that a minor infringement is not an appropriate penalty given the circumstances regarding this case. The only mitigating fact is Mr Bosson's admission of the breach. The aggravating factors are Mr Bosson's poor record under this Rule in the last 12 months. The connections of ALTAI ROSE were inconvenienced at short notice when Mr Bosson was unable to make the contracted weight. The connections deemed there was no suitable replacement rider which resulted in ALTAI ROSE been late scratched which has a detrimental effect on the Club's turnover. As one of the country's leading riders there is always high public interest in Mr Bosson's mounts.
Whilst not unsympathetic that Mr Bosson has on going weight issues it is clear that he has an obligation to Owners and Trainers to complete his riding engagements.
The most significant fact is Mr Bosson and his agent must be more vigilant in accepting appropriate mounts and improve their lines of communication.
After taking into account all the above factors the Committee consider an appropriate penalty is a $400 fine.
