Following race four an information was filed by Stipendiary Steward Mr A Coles, charging defendant J Gillies with excessive use of the whip when riding TOP RODE in race four.

Following race four an information was filed by Stipendiary Steward Mr A Coles, charging defendant J Gillies with excessive use of the whip when riding TOP RODE in race four.

The informant called Stipendiary Steward M Williamson to demonstrate the defendant’s actions on the video of the race.  Mr Williamson indicated that the defendant had struck his mount some 17 times prior to the 200 metre mark, well in excess of the rule.  Mr Williamson noted that after the race he examined the defendant’s mount and did not find any injury or marks on TOP RODE.  He attributed that to the fact that the defendant was using a padded whip.

The informant advised the Committee that it was to the defendant’s credit that he used a padded whip, but the rule had been breached.  A fine of between $150 - $250 was recommended by the informant as being an appropriate penalty.

The defendant reiterated that he used a padded whip, and stated that he had received instructions from the trainer to ride the horse hard – an instruction that had worked on a previous run when the horse was placed third.

DECISION:
The Committee, in determining the penalty, took into account the defendant’s good record, his use of a padded whip, and his plea of guilty.

Imposing a fine of $200, the Committee reminded the defendant that notwithstanding his use of a padded whip, the breach was still one that was publicly viewed.
