As the breach of the Rule was admitted, plus the film evidence left no doubt as to what had occurred, the charge was found proved.

Penalty:

Mr Calder’s Jockey’s Licence was suspended from the end of racing on 30 September through to the the cessation of racing on 9 October 2020 (6 days).

Facts:

Following the running of Race 3 (Super Liquor Matamata 1600) Information No. A13906 was filed with the Judicial Committee. It was alleged that Mr Calder angled RISING RENOWN out to obtain clear racing when not clear of BECAUSE (D Johnson) which was hampered and forced wider. Also inconvenienced was KIPLING (S Collett) near the 200m.

Mr Calder acknowledged that he understood the Charge, the Rule and confirmed that he admitted the breach.

Mr Coles showed the film replays and identified the horses and where the interference occurred. He said that Mr Calder angled his mount out onto BECAUSE who was forced out onto KIPLING, with both runners being hampered and forced wider on the track.

Mr Calder for his part said that he had attempted a run and that Ms Johnson had had to evade his horse and that he did hamper them (outside horses) when not clear. He added that his horse shifted out sharper than he thought it would.

Submissions for Penalty:

Mr Williamson said that the record showed that Mr Calder had one careless riding charge in the last 12 months, that being on 2 January 2020. He placed the carelessness in the low to mid-range.

Mr Calder said that the interference was not intentional and that his horse shifted abruptly and that he had pulled on this left rein. He reiterated that the horse had shifted more than he had anticipated. He asked that any suspension imposed commences after racing on 30 September.

Reasons for Penalty:

It was obvious that near the 200m Mr Calder angled his mount out sharply and in doing so forced BECAUSE off its rightful line of running, and as a consequence BECAUSE forced KIPLING outwards over extra ground. Mr Calder’s mount RISING RENOWN was no more than ¾ length clear when initially shifting.

The Committee placed the carelessness exhibited by Mr Calder as no less than mid-range.

A suspension of 7 riding days was adopted as a starting point, with a discount of one day afforded for good record and the admitted breach.
