Facts:
Following the running of Race 10 (JP Wills Bloodstock 2000) Information No. A13383 was filed with the Judicial Committee. The Informant alleged that Mr Oliver angled his mount SILVER NUGGET out when not clear of ZINZAN (O Bosson) which was checked near the 500m).
Mr Oliver said that he understood the Rule, the Charge and confirmed that he admitted the breach.
Mr Coles showed the film replays, identified both horses and said that Mr Oliver shifted his mount out when approximately one length clear of ZINZAN, resulting in that runner having to be shifted away from heels and being steadied.
Mr Oliver said that he agreed with the Stipendiary Steward’s interpretation of the incident. He added that his horse had blinkers on and proved difficult to ride. He said that the movement was exaggerated due to the blinkers and the characteristics of his horse and that it was only slight carelessness on his part.

Mr Williamson said that Mr Oliver had a clear record, that SILVER NUGGET was a green horse, but nevertheless Mr Oliver had angled out when not clear. He placed the carelessness in the low to mid-range.
Mr Oliver submitted that any suspension imposed could start after 30 September as he had rides on that day.
