As Mr Waddell admitted the breach the Committee found the charge proved.

Penalty:

The Committee grants a deferment to Mr Waddell’s suspension pursuant to Rule 1106(2).

Accordingly, Mr Waddell had his license to ride in races suspended for a period to commence after racing on 2 March and conclude after racing on 10 March 2019.

Facts:

Following the running of race 1,Valchi Downs an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that Mr Waddell permitted his mount EFFERVESCENT to shift in near the 250 metres when insufficiently clear crowding THE HELIX which was forced in crowding LOWRIDER which was checked.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Waddell said he understood the Rule and confirmed that he admitted the breach.

Mr Coles demonstrated the incident using the available video footage. He identified that near the 250 metres Mr Waddell permitted his mount to shift in when only ½ a length clear of THE HELIX. As a result that runner was crowded and forced into the line of LOWRIDER. He noted at that point in the race LOWRIDER was weakening and added that Mr Waddell misjudged his shift inwards.

Mr Waddell said that LOWRIDER was leading the field entering the home straight but it was stopping at the 250 metres. He said that he was following ARITE GURU which “wobbled” around and a gap was presented. He said when he took the gap THE HELIX improved quickly to his inside. He believed there was “not much in it” and the 2 affected horses were crowded more than checked.

Submissions for Penalty:

Mr Oatham produced Mr Waddell’s record which showed 4 previous breaches under this Rule in the last 12 months, the most recent being on 14 November 2018. He said the interference suffered by THE HELIX was “not the worst” and he noted that LOWRIDER was weakening. Mr Oatham described the level of carelessness as low to mid-range and suspension in line with that would be appropriate.

Mr Waddell advised the Committee that he had firm engagements at Ellerslie on 2 March and requested a 7 day deferment. He said that his record was not too bad considering his quantity of rides. He added that today’s breach was a “small error”.

Reasons for Penalty:

The Committee considered all the evidence and submissions presented.

It was evident on the video films that Mr Waddell permitted his mount to shift in 1 horse width when only ½ a length clear of THE HELIX near the 250 metres. The consequential effects were that that runner was crowded and dictated into the line of LOWRIDER who had to be steadied when checked. We accept that LOWRIDER was weakening at that stage in the race. The Committee deemed the level of carelessness to be low range.

The JCA Penalty Guide starting point for low range carelessness is 6 days which was adopted.

There were no aggravating factors.

The mitigating factor was Mr Waddell’s admission of the breach for which he was afforded a 1 day reduction in penalty.

We deemed Mr Waddell’s careless riding record to be a neutral factor.

After taking into account all the above factors the Committee considered that an appropriate suspension was 5 national riding days.
