Following race five an information was filed pursuant to Rule 614(2).  The informant, Mr Coles, told the Committee that Mrs McGiven, trainer of SINEAD, omitted to add the lead bag when presenting SINEAD to race.

DECISION & REASON:

Following race five an information was filed pursuant to Rule 614(2).  The informant, Mr Coles, told the Committee that Mrs McGiven, trainer of SINEAD, omitted to add the lead bag when presenting SINEAD to race. 

Mrs McGiven pleaded guilty to the charge.

Mr Coles said this was a genuine mistake on Mrs McGiven’s part.  He explained she had two horses in the race and the lead bag for SINEAD had slipped off the rail and was then omitted from the gear when being saddled.  This was noticed by Mr Robinson at the pre-race check area and was ordered back to be re-saddled.

Mrs McGiven in admitting full liability said she was rushing to saddle because her rider, Mr Calder, was slow to weigh out.

PENALTY SUBMISSIONS:

Mr Coles said Mrs McGiven had been fully co-operative and it was just a genuine mistake.  He submitted the usual penalty for this offence was a fine of $500.

PENALTY:

The Committee considered all submissions before imposing a fair penalty.  Mitigating factors were Mrs McGiven’s guilty plea, and that this was her first time in the Judicial Room.  However, the consequences can be serious, which it could have been in this case if Mr Robinson had not been vigilant.  Accordingly in the interests of consistency we impose a fine of $500.
