The Committee declared AMOR FATI to be a starter and we authorise payment of dividends pursuant to our decision.

Facts:

Following the running of Race 7 the J Swap Contractors Ltd Matamata Breeders Stakes (Group 2), Stipendiary Steward Mr B Jones, lodged an Information requesting a ruling pusuant to Rule 632 (1) to establish whether AMOR FATI was denied a fair start.

Rule 632 provides “If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placing’s was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.”

Submissions for Decision:

Using available video footage Mr Jones said that AMOR FATI was in barrier position 7 and became agitated prior to the start of the race. The Barrier Attendant took hold of its bridle to settle the horse down. He said that when the start was effected AMOR FATI lunged forward and went down on its hind quarters. As a consequence it was slow away and lost 5 lengths.

Mr Jones submitted it was the Stewards' view was that AMOR FATI was slow away on its own accord. He referred to the relevant rule and emphasised there was no suggestion or evidence of the horse being slow due to a mechanical failure.

Mrs Satherley said that it was “a split second between the barrier opening and her mount flipping over”. She believed it was an unfair start because the Barrier Attendant had hold of her mount's bridle when the gates opened.

The Starter Mr Moody said Mrs Satherley called out at the same time as he activated the start. On viewing the films he submitted AMOR FATI was slow to begin due to the horse's racing manners. He added it was standard practice for Barrier Attendants to steady fractious horses. On this occasion there was nothing untoward in relation to the Barrier Attendant's actions. 

Reasons for Decision:

The Committee carefully considered the submissions presented and reviewed the video footage.

The Committee found that AMOR FATI became unsettled prior to the start and the Barrier Attendant did take hold of it. As the starting gates opened AMOR FATI was fractious but the Barrier Attendant released his hold on the horse. It reared and went back on its hind quarters on its own accord and lost a conservative 5 lengths. We do not believe that fault can be attributed to any action or in-action on the part of the Barrier Attendant. In our view fault rests with the horse's manners.

Further, it is the opinion of the Committee there was no mechanical failure of starting stalls, nor was AMOR FATI denied a fair start as a result thereof. Therefore we rule that AMOR FATI was slow away of its own accord.
