We suspend Ms Farr from riding in races from after racing at Ellerslie on 24 September until after racing at Te Rapa on 30 September 2016-a 4 days penalty.

Facts:

Following the running of Race 1, the WAIKATO BRANCH NZ FARRIERS ASSOCIATION 1600 an Information was laid by Mr Jones alleging that Apprentice Rider Ms Farr allowed her mount MR DAVINCI to shift in near the 250 metres causing a check to NOMBERO, ridden by Mr M Coleman.

Ms Farr, who was assisted by Apprentice Riders Mentor Mr Noel Harris, was present at the hearing and acknowledged that she understood the Rule and that she admitted the breach.

Rule 638 (1) (d) provides that ' A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless'.

Using the available video films Mr Oatham identified the horse MR DAVINCI as the field entered the home straight. The horse was towards the rear of the field, with NOMBERO, ridden by Mr Coleman behind it. Mr Oatham pointed out that Ms Farr drew the whip on her mount in an effort to improve its position. In doing so the horse reacted and shifted inwards and impeded NOMBERO which was also attempting to improve on the inside of MR DAVINCI. Ms Farr continued to ride forward on her mount which put more pressure on Mr Coleman who was obliged to take evasive action. Mr Oatham further pointed out that Ms Farr was never the required distance ahead of Mr Coleman and had not made an effort to straighten her mount when it began racing erratically. Mr Oatham informed the Committee that the Stewards were aware from previous incidents that MR DAVINCI did not have the best racing manners.

Ms Farr stated that MR DAVINCI was the 'hardest' horse she had ever ridden. She said that the horse had veered 'dramatically' to the left when she hit it with her whip and she also acknowledged that she should have stopped riding the horse out and straightened it immediately when it raced roughly. Ms Farr added that the horse STAN'S TOUGH TIGER, ridden by Ms A Sims, had been outside her before this incident and had moved inwards slightly which put further pressure on her. She added that MR DAVINCI was a very difficult horse to ride in any circumstances.

Mr Harris said that Ms Farr had erred in continuing to ride forward with the whip after her mount had begun an inwards movement.

Submissions for Penalty:

Mr Jones produced Ms Farr's riding record which showed one prior breach of this Rule within the past 12 months; a 3 day suspension incurred on 3 July 2016. Mr Jones stated that the Stewards believed this incident fell into the low-mid range on the scale of seriousness and believed that a period of suspension of Ms Farr's riding licence was called for. He added that to her credit was that she had admitted the breach and that she had a good prior record. Mr Jones produced evidence which showed Ms Farr had ridden quite extensively throughout the North Island at Industry meetings and could correctly be termed a ' North Island' rider.

Ms Farr told the Committee that she had riding engagements at Ellerslie on 24 September and could start any suspension after that day.

Reasons for Penalty:

The Committee took careful note of the submissions of the parties and also viewed the films of the incident. It was clear that Ms Farr was having difficulty controlling her mount, however she was at fault in not stopping riding the horse out when it began to race in an eratic manner. It was fortunate that Mr Coleman, who is an experienced rider, could see what was taking place ahead of him and took evasive action to avoid any serious consequences. It was clear to the Committee that the incident was towards the mid range on the scale, and while we accepted that horse was a difficult ride for Ms Farr, she should have anticipated its behaviour and taken appropriate action.

The JCA Penalty Guide has a starting point of a 5 day suspension for a breach of this Rule. We take into account Ms Farr's admission, her good record, and the fact that she is a relatively inexperienced rider. We accept that she can be classed as a ' North Island' rider.

We believe that this breach calls for a suspension of Ms Farr's riding licence.
