Following Race 8 Stipendiary Steward AC Coles filed an information charging Defendant C Ormsby with careless riding (Rule 871 (1) (d), alleging that he permitted his mount Jungle Charmer to shift inwards near the 100 metres when not sufficiently clear, dictating Overthelign (J.McDonald) into the line of Money Shop (K Hercock) who was checked.

The Informant and Defendant confirmed to the Committee that they consented to the hearing being progressed without the Defendant’s employer being present. He had viewed the relevant video films of the race and had been fully appraised of the charge.

For the Informant Stipendiary Steward M Williamson demonstrated the video films and showed the Committee how the Defendant, over a sustained period of ground, had allowed his mount to shift in gradually, to the extent that he had dictated Overtheline into the line of Money Shop, checking that horse in a chain reaction.

The Defendant stated that he was not aware of the extent of his inner movement and drew the Committee’s attention to the fact that he had not received a call from the rider of Overthelign as the movement occurred.

Addressing penalty, the Informant advised that he considered the Defendant’s record to be very good, and worthy of consideration. He also confirmed that the Defendant had been forthright when spoken to over the breach. The Informant opined that the riding breach was sufficient that a suspension being imposed and recommended a period of 4 days.

The Committee, considering penalty, took into account the Defendant’s record, the degree of interference and his attitude to the charge.
----
The Committee accepted the Informant’s recommendation as consistent with precedent cases and imposed a suspension of 4 days. Heeding a request for a stay until after a meeting on the 26 November 2008, the Committee ruled that the Defendant’s suspension commence at the conclusion of racing on the 26 November 2008, and end at the conclusion of racing on the 30 November 2008.
