Following Race 7 the Informant, Stipendiary Steward AC Coles, charged rider Jason Waddell with careless riding under Rule 871 (1) (d)  - alleging that as rider of Better On Top he permitted his mount to shift inwards near the 100 metres mark when not sufficiently clear of Tomohiro Sasada’s mount, Klassic Singer, causing that horse to be checked.   



Following Race 7 the Informant, Stipendiary Steward AC Coles, charged rider Jason Waddell with careless riding under Rule 871 (1) (d)  - alleging that as rider of Better On Top he permitted his mount to shift inwards near the 100 metres mark when not sufficiently clear of Tomohiro Sasada’s mount, Klassic Singer, causing that horse to be checked.

Stipendiary Steward J Oatham demonstrated the video films and showed that at about the 100 metres mark Klassic Singer was trailing Shodan (T Harris) when a clear run opened for him when Shodan rolled out. As Klassic Singer moved forward into the gap he was

forced aside by Better On Top when the Defendant, improving swiftly from the back of the field, moved across the back of Shodan’s heels and pushed forward in front of Klassic Singer.  Better On Top, never sufficiently clear of Klassic Singer, caused that horse to be checked.

Mr Oatham, referring to the side on video, detailed how the Defendant was never clear of Klassic Singer, opined that there was “never a run available” and that the Defendant, riding forward, should have taken hold of his mount at that time.

Rider Sasada confirmed to the Committee that, whilst he had doubt of Klassic Singer’s ability to take the gap, he maintained his line towards it until pushed aside by the Defendant and checked.

Mr Waddell then gave evidence, using the video to demonstrate his submissions. He  claimed that Shodan rolled out in front of him as he was rapidly moving forward and that  had no option other than to take the gap in front of Klassic Singer – otherwise he would have fallen. He conceded that he had caused interference to Klassic Singer, but maintained that because of the many contributing factors he should not have been charged.

In his final summation, the Informant stated that he considered the check to Klassic Singer to be severe, and that the Defendant had continued to ride forward at a time when he should have held his mount up.

The Committee, having considered the evidence and video films review, concluded that Mr Oatham’s  interpretation of the interference and jockey Sasada’s evidence proved the Informant’s allegation. The Committee found that at all material times the Defendant had maintained forward movement of his mount – doing so when he should have held the horse back.

Having found the breach proven, the Committee asked for submissions on penalty from the Informant and Defendant.

Mr Coles advised the Committee that the Defendant was currently riding under a 7 day stay allowed for following the imposition of a 4 day suspension – that suspension to end at the conclusion of racing on 28 November 2008. Mr Coles detailed  previous suspensions imposed on the Defendant which revealed that his record to be of concern. He concluded that the severity of the interference which the Defendant had caused warranted a further suspension and recommended a period of 5 to 7 days.

Mr Waddell reiterated to the Committee that he felt it was unfair that he had been singled out, that other rider’s contributions to the interference were factors to be considered. He also pointed out that he rides extensively throughout New Zealand and has mounts in nearly every race at meetings he attends.

Factoring in the Defendant’s prior record and the severity of the interference, the Committee imposed a penalty of suspension for 6 days; to commence at the conclusion of racing on the 28 November 2008, and to conclude at the end of racing on the 6 December 2008.
