As the breach was admitted we find the charge proved.

Penalty:

After taking the above matters into consideration, and accepting Miss Spratt's admission as a mitigating factor balanced by her record in the past 12 months which is not to her credit, we impose a penalty of (4) days suspension on Miss Spratt, which is to begin after racing at  Ellerslie on 26 December and finish after racing at Stratford on 31 December 2012.

30 December         Taupo
31 December         Stratford
The penalty is imposed taking into account the provisions of Rule 1106 (2).

Facts:

Following the running of Race 8 an information was filed  by Stipendiary Steward Mr M Williamson against licensed jockey Miss S Spratt alleging a breach of Rule 638(1)(d) in that she permitted her mount 'SAM MESI' to shift inwards when not sufficiently clear of 'LEAVE PASS' which was taken inwards crowding 'GRACE O'MALLEY' which lost its line of running near the 50 metre mark.

Submissions for Decision:

This race was over a distance of 1600 metres and the alleged interference took place between 120 metres and 50 metres from the finish.
Mr Oatham demonstrated the available video films which showed 'SAM MESI' ridden by Miss Spratt in a 4 wide position at about the 120 metre mark. On her inside were 'LEAVE PASS' ridden by Mr C Grylls, and inside that runner was 'GRACE O'MALLEY', Ms T Thornton. The horses 'SAM MESI' and 'LEAVE PASS' were in close proximity to each other, in a leading position, 'GRACE O'MALLEY' was a short distance behind them but attempting to challenge the leaders. At that time there was adequate room for 'GRACE O'MALLEY' to improve if good enough. On the inside of 'GRACE O'MALLEY' was 'COUGAR TOWN' ridden by Mr A Calder.
 
'SAM MESI' was under a hard ride from Miss Spratt while challenging for the lead, and shifted inwards under the whip, making contact with 'LEAVE PASS'. Miss Spratt continued to ride forward with the whip. At about the 50 metre point in the race the movement inwards by 'SAM MESI' had amounted to approximately 1 1/2 horse widths, and that movement towards 'LEAVE PASS' had forced the horse across into the path of 'GRACE O'MALLEY' forcing Ms Thornton to restrain that horse, which moved inwards and made slight contact with 'COUGAR TOWN' on its inner.
 
Mr Oatham conceded that the inwards movement by 'SAM MESI' was relatively slight, however he was concerned that Miss Spratt had continued to urge the horse forward with the whip after it begain to drift inwards.  Mr Oatham added that the interference to 'GRACE O'MALLEY' had affected its chances, the horse eventually finishing in 5th position after failing to regain its momentum. Connections of that horse had viewed the films with a view to protesting, however elected not to proceed.
 
'LEAVE PASS' won the race with 'SAM MESI' finishing second and 'COUGAR TOWN' third.
 
Miss Spratt when asked for comment stated that she had nothing to add.

Submissions for Penalty:

Mr Willamson told the committee that Miss Spratt had incurred 4 periods of suspension in the past 12 months:
17/11/2011 (4 days), 7/4/2012 (6 days), 17/3/2012 (4 days), 4/2/2012 (4 days).  He told the committee that the breach had been at the lower end of the scale of seriousness and that it could be dealt with by way of a suspension.
 
Miss Spratt told the committee she had commitments at Awapuni on 22 December and Ellerslie on 26 December and would like any suspension to begin after Ellerslie.

Reasons for Penalty:

The committee carefully considered the evidence and submissions. The incident took place a short distance from the finish, and  the horse 'GRACE O'MALLEY' had its chances of finishing closer compromised. Of concern was the fact that Miss Spratt continued to ride with the whip after her horse began its inwards movement. We accept that the interference to 'LEAVE PASS' was of a minor nature, however the resulting check to 'GRACE O'MALLEY' must be taken into consideration.
