Decision:

As Mr Dell admitted the breach we find the charge proved.

Penalty:

Accordingly, we impose a suspension on Mr Dell which will commence after racing on 19 January and conclude after racing on 28 January 2013 (6 days).

Charge:

Following race 6, an information was filed pursuant to Rule 638(1)(d). The informant, Mr Coles alleged that shortly after the start (1900 metres) Mr C Dell allowed his mount TED''LL DO to shift in, crowding CAP FERRAT into the line of NO NONSENSE who was hampered losing ground.

Mr Dell acknowledged that he understood the rule he was charged under.

In answer to a question from the Committee, Mr Dell advised us that he had no objection to the hearing proceeding without any assistance.

Facts:

Mr Williamson demonstrated on the video films that Mr Dell allowed his mount to shift in 100 metres after the start. In doing so, he dictated CAP FERRAT into the running line of NO NONSENSE who was hampered and lost ground.

Mr Dell said shortly after the start fellow riders were jostling for positions. He conceded that he moved in 1 to 1 ½ horse widths which had a detrimental effect on 2 other horses.

Submissions for Penalty:

Mr Coles produced Mr Dell's record which showed 7 previous breaches under this rule in the last 12 months. He said Mr Dell had made an error of judgement and as result caused interference. He submitted the level of carelessness was at the low end. He submitted the Committee needed to take into consideration Mr Dell's record when fixing penalty.

Mr Dell submitted that he had commitments up to January 19. He submitted to the Committee that he needed to address his poor riding record. He believed the level of carelessness was low end.

Mr Dell confirmed he was not intending to ride at Gore on January 24.

Reasons for Penalty:

The committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The mitigating factors are Mr Dell's admission of the breach and the level of carelessness which we assess as low end. However, the significant aggravating fact is Mr Dell's poor record. After taking into account all the above factors we assess an appropriate penalty is 6 North Island days.

The Committee expressed their concern of Mr Dell's record and recommended him to seek further tuition at Apprentice School.
