Accordingly, the Committee declared COPS N COYOTE to be a non – starter.
Facts:
Following the running of Race 6, Paper Plus Matamata 2000, an Information was filed pursuant to Rule 632. The Informant, Mr D Lang, Request a Ruling as to whether his horse COPS N COYOTE was denied a fair start due to the gate being slow to open.
Rule 632 provides “If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-starter.”
Submissions for Decision:
Mr Lang told the Committee that he had been advised by the Stipendiary Stewards COPS N COYOTE gate had not opened properly. He demonstrated on the video films that COPS N COYOTE gate was clearly slow to open. He said that his horse liked to lead or run near the pace, and that he had instructed Mr Dee to use his good barrier draw (5) and lead. He added COPS N COYOTE was a one paced horse and believed the slow gate had a detrimental effect on its chances with him settling at the rear.
Mr Dee told the Committee that when the start was activated every other horses' gate opened while his was still shut. He added that COPS N COYOTE forced it's gate open which clearly inconvenienced his chances.
In response to a question from the Committee, Mr Dee stated he lost 1 ½ lengths due to the slow gate.
Mr Coles submitted it was clear that COPS N COYOTE gate was shut when all the others opened. He acknowledged this cost the horse ground and was aware that COPS N COYOTE was an on pace runner.
Reasons for Decision:
The Committee carefully considered the submissions presented and reviewed the video films several times. It was clear COPS N COYOTE gate was slow to open due to a mechanical failure of the starting stalls. We are satisfied this materially prejudiced the chances of COPS N COYOTE. We believe the incident cost COPS N COYOTE approximately 2 lengths.
We also note that COPS N COYOTE in his last 3 starts raced in or near the lead and the slow gate prevented him from doing so today.
