Matamata RC 17 April 2019 – R 2 – Chair, Mr A Dooley
ID: JCA16886
Code:
Thoroughbred
Meet Title:
Matamata RC - 17 April 2019
Meet Chair:
ADooley
Race Date:
2019/04/17
Race Number:
R2
Decision:
As Mr Grylls admitted the breach the Committee found the charge proved.
Penalty:
The Committee granted a deferment to Mr Grylls’ suspension pursuant to Rule 1106(2).
Accordingly, Mr Grylls had his license to ride in races suspended for a period to commence after racing on 22 April and conclude after racing on 1 May 2019.
Facts:
Following the running of race 2, The Matamata Function Centre 1600, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mr Grylls angled his mount KYA KHOOB LAGTI HO inwards crowding AMBITIOUS SHOWGIRL which was forced inwards across the heels of CLEARLY NOW near the 1400 metres.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Grylls said he understood the Rule and confirmed that he admitted the breach.
Mr Oatham demonstrated the incident using the available video footage. He identified that Mr Grylls angled his mount inwards when only ½ a length clear of AMBITIOUS SHOWGIRL. As a result that runner was placed in restricted room and forced inwards across the heels of CLEARLY NOW.
Mr Grylls accepted that he shifted in when not the required distance clear of AMBITIOUS SHOWGIRL. He said although the manoeuvre placed that runner in a tight position it was in no danger of clipping a heel.
Submissions for Penalty:
Mr Williamson said that Mr Grylls has had 198 rides in NZ since returning from Singapore earlier this year. He said Mr Grylls had 1 previous breach of this Rule and described this as a relatively good record. He assessed the level of carelessness as low range and a suspension in line with that would be appropriate.
Mr Grylls said he had firm engagements at Rotorua on 22 April and any proposed suspension could start after that date. He added that his record is good and he generally has a full book of rides.
Reasons for Penalty:
The Committee considered all the evidence and submissions presented.
It was clear on the video films that Mr Grylls permitted his mount to shift inwards 200 metres after the start when only ½ length clear of AMBITIOUS SHOWGIRL. As a consequence that runner was dictated inwards across the heels of CLEARLY NOW. The Committee deemed the level of carelessness displayed by Mr Grylls as low range.
The JCA Penalty Guide starting point for low range carelessness is 6 national days which was adopted.
There were no aggravating factors.
The mitigating factors were Mr Grylls’ admission of the breach and his good record. For these collective factors Mr Grylls was afforded a 1 day reduction in penalty.
After taking into account all the above factors the Committee considered that an appropriate suspension was 5 national riding days.
