As Mr Holmes has admitted the breach we find the charge proved.
Penalty:
Accordingly we suspend Mr Holmes' license to ride in races from after racing on 21 January until after racing on 30 January - 6 days.

Facts:
Following the running of Race 8, the TRAC SPORTS BAR 2000, an Information was lodged pursuant to Rule 638(1)(d) by Stipendiary Steward Mr M Williamson. The charge stated that Licensed Jockey Mr P Holmes permitted his mount REVELATOR to shift inwards when not clear of CHAZELLE (Mr M Du Plessis) which clipped a heel and blundered near the 1850 metres.
Mr Holmes acknowledged that he understood the charge and confirmed that he wished to admit the breach.
Rule 638(1)(d) states ' A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless'.
This race was over the distance of 2000 metres. REVELATOR started from barrier position 6, with CHAZELLE two places inside at barrier 4.
Mr McIntyre demonstrated the incident using the available films. The head-on film showed the field at the start, and Mr McIntyre identified REVELATOR, which had made a good beginning. Mr Holmes can be seen looking to his inside as he angles REVELATOR towards the running rail. He makes a slight correction as he realises CHAZELLE is too close to him, however then again lets REVELATOR shift inwards. At that time he was only a bare length clear of CHAZELLE, which resulted in CHAZELLE clipping the heels of REVELATOR. As a result CHAZELLE blundered quite badly and went down on its nose. Mr Du Plessis was badly disadvantaged and did well to retain his irons and continue the race.
Mr Holmes stated that he accepted that he was not the required distance clear of CHAZELLE when he allowed REVELATOR to shift inwards. He added that in his opinion Mr Du Plessis had not been looking forward at the time and that he had not 'called out' to him.
Submissions for Penalty:
Mr Williamson produced Mr Holmes' riding record. He said that Mr Holmes had until recently been riding in Queensland, and within the past 12 months he had two breaches of a similar Rule in that State. On 23 November 2014 at the Sunshine Coast he had been suspended from that day until 3 December. At Doomben on 5 December he was suspended from 6 December until 19 December 2014. In New Zealand he had two 4 day suspensions on the same day (11 September 2014) at Taranaki.
Mr Williamson added that it was clear that Mr Homes had shifted in when not sufficiently clear of Mr Du Plessis. As a result of his mount clipping heels Mr Du Plessis had all but been dislodged and there could well have been dire consequences for horse and rider.
Mr Williamson made reference to jockey D who had been suspended recently for 6 days for a similar breach. He said that the Stewards viewed this incident to be mid-high range on the scale of seriousness and submitted a 6-7 day suspension would be appropriate.
Mr Homes had nothing to add. He said that he was able to commence a suspension after riding at Rotorua on 21 January. He told the Committee that he intended domiciling himself permanently in New Zealand for the foreseeable future.
Reasons for Penalty:
The Committee carefully considered the evidence and submissions presented. We adopted 5 riding days as the starting point in considering an appropriate penalty. While we accept that Mr Holmes has admitted the breach and that his record is average, we are concerned at the level of carelessness displayed by Mr Holmes. It was apparent that his actions almost caused a fall, which had it occurred, would have resulted in a more serious charge with a subsequent severe penalty applied. We assess that level of carelessness was mid range but the consequences were mid-high level and feel that any penalty must be seen to reflect that.
After taking all of the above into consideration the Committee consider a period of suspension of 6 days to be appropriate.
