As Ms Dravitski admitted this breach we find the charge proved.

Penalty:

Ms Dravitski's license to ride in races is therefore suspended for a period which will commence after racing on 19 January until after racing on 25 January 2015 - 4 days.

Facts:

Following the running of Race 3, the WAIKATO BRANCH NZ FARRIERS ASSOCIATION 1400 Stipendiary Steward Mr Williamson laid an Information alleging that Apprentice Jockey Ms M Dravitski allowed her mount to shift inwards taking CAYO COCO inwards onto ALBIREO, resulting in CAYO COCO being checked and losing ground passing the 1000 metres.

Ms Dravitski acknowledged that she understood the breach and that she admitted the charge. As an Apprentice Jockey Ms Dravitski was entitled to have a senior industry member assist her at the hearing, however she told the Committee she was prepared to proceed without any one to assist. The Committee took into account her relative seniority as an Apprentice and agreed to continue the hearing on that basis.

Rule 638(1)(d) states' A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless'

Mr McIntyre used the available films to demonstrate the incident. He pointed out that Ms Dravitski, riding ALL JOKES ASIDE was racing on the outside of CAYO COCO ridden by Apprentice Rider J Wong at about the 1000 metres. Inside that horse was ALBIREO ridden by Apprentice Rider R Hutchings. Ms Dravitski attempted to shift inwards to obtain a better position for her mount, however in doing so she placed pressure on CAYO COCO which had to be checked by Mr Wong. This in turn placed pressure on ALBIREO. It was apparent from the films that CAYO COCO had been over-racing just prior to this incident and Mr Wong took a firm hold of the horse and directed it out away from ALL JOKES ASIDE. Mr McIntyre told the Committee that there was never enough room for Ms Dravitski to shift in as she was not the required distance clear of CAYO COCO. Mr McIntyre also pointed out that the horse ALBIREO had made a sudden movement outwards at the time of the incident which had been a contributing factor to what took place.

Ms Dravitski said she believed that CAYO COCO had been racing ungenerously and that she thought she was the required distance clear of that horse prior to directing her horse inwards.

Submissions for Penalty:

Mr Williamson produced Ms Dravitski's riding record which showed she had one suspension for 6 days on 26 December 2014. He said it was to her credit that Ms Dravitski had admitted the breach.  He added that there were a number of cirumstances which resulted in this incident taking place, however the Stewards viewed Ms Dravitski's culpability to be at the low end on the scale of seriousness. The Stewards felt these matters could be taken into consideration when assessing a likely penalty. He added that she had only been a bare length clear when attempting to shift inwards in front of Mr Wong. 

Ms Dravitski said that she believed the incident was at the low end of the scale, and that her record of one suspension in the last 12 months was a good one. She added that she was able to begin her suspension after racing on 19 January 2015.

Reasons for Penalty:

The Committee took into consideration the submissions of the parties, and viewed the films of this incident. It was apparent that Mr Wong's horse had been over-racing, and that Mr Hutchings' mount had made an abrupt outwards movement at about the same time Ms Dravitski attempted to shift inwards. However this interference would not have taken place had Ms Dravitski ensured she was the required distance clear of Mr Wong before attempting to shift her mount inwards. In fixing an appropriate penalty we are guided by the JCA Penalty Guide which has a starting point of 5 days suspension for a charge of careless riding.

We take into account Ms Dravitski's very good record, and that she has admitted the breach. We agree that her negligence was at the lower end of the scale and taking all of these factors into consideration we believe a period of suspension of 4 riding days would be appropriate.
