Accordingly Mr Norvall's license to ride in races is suspended from after racing on 19 December to after racing on 27 December 2015 - 3 days.

Facts:

Following the running of race 5, the NZB INSURANCE PEARL SERIES RACE, an Information was laid by Stipendiary Steward Mr B Jones alleging that Class A Rider Mr R Norvall permitted his mount NEALA to shift inwards shortly after the start when not sufficiently clear of MISS HOROTIU which was checked.

Mr Norvall was present at the hearing and acknowledged that he understood the Rule and that he admitted the charge.

Rule 638(1)(d) provides that " A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless'.

Using the available films, Stipendiary Steward Mr J Oatham identified the horses concerned. He stated that NEALA had started from barrier 6, with MISS HOROTIU, ridden by Mr M Coleman, inside him. Shortly after the start NEALA had shifted inwards into the line of running available to MISS HOROTIU, causing Mr Coleman to take a firm hold of that horse which resulted in it losing its position. It was clear on the film that Mr Coleman was riding his mount forward at the time. Mr Oatham stated that NEALA was less than a length clear of MISS HOROTIU at the time this incident took place.

Mr Norvall acknowledged that he had moved inwards and put pressure on Mr Coleman's mount, however he told the Committee that MISS HOROTIU had been in his 'blind' spot, and while he had looked behind prior to moving inwards he had failed to see the horse. He said that he believed there was pressure on MISS HOROTIU from horses on its inside and that all the riders were jostling for positions after the start of the race.

Submissions for Penalty:

Mr Jones stated that Mr Norvall had one previous breach of this Rule - on 20 June 2015 - in the previous 12 months. He added that the Stewards believed the incident was low to mid range on the scale of seriousness and that it was to Mr Norvall's credit that he had admitted the breach. He felt that the breach could be dealt with by way of a suspension of Mr Norvall's riding license.

Mr Norvall stated that he had rides at Te Rapa on 19 December and that a suspension could commence after that meeting. He added that he had ridden at Feilding on 31 October 2015 and that he took mounts at mid-week meetings throughout the North Island when he could.

Reasons for Penalty:

The JCA Penalty Guide calls for a starting point of a 5 day suspension when assessing penalties for breaches of this Rule. Mr Norvall has had one breach of the Rule - for which he was given a 3 day suspension - within the last 12 months. While he does not ride as often as some jockeys, that is still a very good record. The Committee accepts that this breach was at the lower end of the scale on the level of seriousness. Mr Norvall has accepted responsibility for this incident and admitted the breach at the first opportunity. These are significant mitigating factors, and Mr Norvall should therefore be given credit for them when a penalty for this breach is being assessed.

The Committee therefore is satisfied that a penalty of a 3 day suspension is therefore warranted.

The Committee accepts that Mr Norvall has ridden at mid-week meetings throughout the North Island when he has the opportunity to do so.
