Facts:
Following the running of Race 2, the Pearson 2000, Mr Jones, Stipendiary Steward presented an Information alleging that Mr C Thornton, Class D Jumps Jockey, breached Rule 638(3)(b)(ii) by using his whip to an extent which was excessive. Mr Thornton admitted the charge.
Mr Jones illustrated from the race films that Mr Thornton, riding the horse HAKUNA MATATA strike it 9 times with the whip prior to reaching the 100 metre point. The horse finished 3rd. Mr Thornton was having his first ride for a very long time but was aware of the Rule. He said he made an error of judgment when all horses were battling in the ground.
Submissions for Penalty:
The Informant's submission was that as this was a first breach of the Rule a fine of $300 was appropriate.
Mr Thornton accepted that a fine had to be imposed.
