As the breach was admitted with found the charge proved.
Penalty:
After taking all of the above into consideration and under the provisions of Rule 1106 (2) we impose a suspension on Mr Colgan from riding in races which is to start after racing on 13 October and conclude after racing on 20 October 2012 (4 days ).

Facts:
Following the running of Race 1, an information was laid by Stipendiary Steward Mr J Oatham against licensed jockey Mr V Colgan, alleging a breach of Rule 638 (1)(d) in that he permitted his mount 'GRACE O'MALLEY' to shift inwards at about the 1250m mark when not sufficiently clear of 'SULTRY ASSASSIN' (A Calder) which was taken into the line of SKY HI BABY (S Shirahama) which clipped a heel and blundered.
Submissions for Decision:
Stipendiary Steward, Mr W Robinson demonstrated the video film, initially the head-on film of the horses after the start of the race as they made their way up the back straight. The race was over 1600m and had started at the head of a chute giving the riders and horses ample time to find a suitable position before any turns had to be negotiated. At a position around the 1250 metre mark it was apparent that 'GRACE O'MALLEY' was 3 horses wide, in or near the lead, and when barely a length clear had moved inwards forcing SULTRY ASSASSIN (A Calder) to shift inwards taking the line of SKY HI BABY (S Shirahama) which clipped a heel and blundered. Mr Robinson pointed out that the horse inside SKY HI BABY - TINKER ROSE (Mrs T Thornton) was moving around at the time but that he did not believe this contributed to the incident. He added that Mr Colgan 'almost got away'with the manoeuvre, however was culpable as he was not the required distance clear at the time he commenced it.
Mr Colgan had nothing to add when asked for any comment about the incident.
Submissions for Penalty:
Mr Oatham told the Committee that Mr Colgan had incurred one breach of the careless riding rule in the last 12 months. He stated that he considered this incident to be an error judgement on Mr Colgans' part, and that he did not believe Mr Colgan had any intent to inconvenience any other horse or rider. He stated that in his view the incident fell towards the lower end of the scale of seriousness, however he stated that a period of suspension was called for.
When asked for his riding commitments after that day, Mr Colgan said he wished the period of suspension to start immediately after that day's racing was completed. On being questioned by the Committee he stated that he had had firm commitments to ride at Ruakaka on 17 October, and firm commitments to ride at Ashburton on 19 October. He told the Committee that his riding agent had contacted the trainer of the horses he was contracted to ride at Ruakaka who had released him from those commitments. Clarification on his riding at Ashburton was sought and he told the Committee his riding agent had committed him to rides at that meeting, particuarly a 3 year filly in a Listed race that day, with the promise of riding that filly in the 1000 Guineas at Riccarton in early November if the filly ran well enough. He said his agent had sought and was given a release from that engagement. The Committee accepted his assurances over these engagements.

The Committee has considered the evidence produced and the submissions that followed. We take into account that the incident occurred in an early part of the race when riders were attempting to position their mounts for the rest of the event. We accept that there was no malice by Mr Colgan and that he admitted the breach at the first opportunity. Balancing these factors, two horses inside Mr Colgan's mount were hampered and their chances later in the race may have been affected. We accept that the breach is in the lower end of the level of seriousness.
