As Ms Satherley admitted the breach it was found to be proved by the Committee.

Penalty:

Ms Satherley’s Jockey’s Licence was suspended from after racing on 17 January up to and including all racing on 24 January 2018.

Facts:

Following the running of Race 2, (Stable Books 1600), Information No. A7335 was filed with the Judicial Committee. It alleged that Ms Satherley the rider of HARRY DUNNE allowed her mount to shift out near the 100m when not sufficiently clear of UNNAMEABLE which was checked.

Rule 638(1)(d) provides:
A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
   careless

Ms Satherley acknowledged that she understood the Rule, Charge and confirmed that she admitted the breach.

Mr Coles showed all film replays and identified Ms Satherley’s mount HARRY DUNNE with UNNAMEABLE (A Collett) racing to its outside and slightly behind. He said that near the 100m Ms Satherley angled outwards resulting in UNNAMEABLE being checked. He added that Ms Satherley had hit her horse once with the whip and that it had ducked out. He said that in mitigation OVER TORQUE who was racing on the inside of Ms Satherley had laid out.

In response to a question from the Committee Mr Coles said that HARRY DUNNE was no more than one length clear of UNNAMEABLE when it shifted.

In response Ms Satherley told the Committee that her horse had been a little difficult to handle in the straight and that OVER TORQUE had shifted out towards her horse. She added that when she hit her horse with the whip it had ducked out quickly.

Submissions for Penalty:

Mr Jones said that Ms Satherley had only breached the careless riding Rule once in 12 months, that being on 9 December 2017 when a 6-day suspension was imposed. He placed the carelessness in the low-range category and noted that the JCA Penalty Guide for low-end carelessness was a 6-day suspension.

Ms Satherley had nothing to say in terms of actual penalty but asked that any suspension imposed commence after racing on 17 January.

Reasons for Penalty:

In assessing penalty the Committee took into account the submissions of both parties and its own observations of the film evidence. It was clear that Ms Satherley had shifted abruptly when not the required distance clear. The Committee also took into account the shift by OVER TORQUE. The carelessness exhibited by Ms Satherley was deemed to be in the low-range and having regard to the JCA Penalty Guide, the admission of the breach and Ms Satherley’s very good record, the Committee believed that a discount of one day from the starting point of a 6-day suspension was the appropriate penalty.
