Facts:
Following Race 5 (COMAG Ltd 1200), Information No.A12947 was filed with the Judicial Committee. It alleged that Mr Bosson attempted to weigh out without a body protector.
Mr Bosson said that he understood the Rule, the Charge and confirmed that he admitted the charge.
Mr Jones said that Mr Williamson observed the weigh-out and that it was a genuine attempt to weigh out without a vest by Mr Bosson.
Mr Williamson said that when Mr Bosson came to the scales he could see his singlet through the colours but that he was not wearing a vest. He said that Mr Bosson weighed at 57.09kg. He then made Mr Bosson aware he was minus his vest and after adding the vest he removed a girth sleeve and re-weighed at the same weight (57.09kg). Mr Williamson said that Mr Bosson said that he forgot to put the vest on.
Mr Bosson for his part said that he was in a rush, quickly rushed out to the scales and forgot the vest. He said that he re-weighed at the same weight and it was a genuine mistake.

Mr Jones advised the Committee of previous penalties imposed for breaches of Rule 649(1)(a). Those penalties ranged from fines to suspensions. He said that this was Mr Bosson’s first breach of the Rule.
Mr Bosson said that he had been working hard on his weight to be at a competitive level. He asked for a fine as a suspension would not help his weight situation at all.
Reasons for Penalty:
The Committee considered all of the submissions carefully. As this was the first breach of the Rule by the Respondent it was considered that a fine was a suitable penalty.
