As Mr Lammas admitted the breach we find the charge proved.

Accordingly, Mr Lammas was fined $350.

Charge:

Following race 4, Farmlands & Repco Handicap 1400, an information was filed pursuant to Rule 330(3)(c). The Informant, Mr Williamson, alleged that Mr Lammas was unable to make the weight for SO KEEP ME.

Mr Lammas acknowledged that he understood the nature of the charge and the Rule.

Rule 330(3) (c) provides: A rider shall not fail to ride a horse at the weight at which it is handicapped to carry.

Facts:

Mr Williamson told the Committee that when Mr Lammas arrived on course he advised the Stewards that he was unable to make the weight (54kg) for his ride on SO KEEP ME. He said Mr Lammas intended to have a sauna at the Matamata pools however, upon arrival it was found that the sauna was turned off. Therefore, Mr Lammas was unable to lose the required weight.

Mr Lammas said that he arrived at Matamata early to lose the necessary 1 kilo. He confirmed that the sauna was not turned on and he reverted to having a spa. He said he tried his best to lose 1 kilo but unable to. He added the connections would have accepted 0.5kg over the carded weight.

Submissions for Penalty:

Mr Williamson produced Mr Lammas' record which showed 4 previous breaches under this rule in the last 12 months. The most recent breach was on the 13th June which attracted a $300 fine. He said Mr Lammas had a real problem with his weight and advised him any further breaches under this Rule the Stewards would seek a suspension. He said Mr Lammas had been up front with the Stewards and submitted a fine in the vicinity of $300 would be appropriate.

Mr Lammas submitted that he tried his best to lose the required weight and believed a $300 fine was appropriate.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The mitigating fact was Mr Lammas' admission of the breach. The aggravating factors were this was Mr Lammas' 5th breach in the last 12 months and connections were let down by Mr Lammas being unable to make the carded weight.

The Committee accepts Mr Lammas did endeavour to lose the necessary weight albeit unsuccessfully.

The Committee referred to similar recent breaches which showed fines of $350 and $400.

The Committee told Mr Lammas that any further breach under this Rule would result in a suspension due to his poor record. I recommended to him that he and his agent must be more vigilant in accepting mounts above 54.5kg.

After taking into account all the above factors the Committee considers an appropriate penalty is a $350 fine.
