Following race one an information was filed pursuant to Rule 530(2)(b). The informant, Mr Coles, alleged that Mr P Turner, rider of TESTASTRETTA, used the whip in an excessive manner.

Following race one an information was filed pursuant to Rule 530(2)(b). The informant, Mr Coles, alleged that Mr P Turner, rider of TESTASTRETTA, used the whip in an excessive manner.
--Mr Turner admitted the breach.
--Mr Oatham demonstrated the video films which clearly showed Mr Turner striking his mount approximately 15 times before the 200 metre mark. His mount TESTASTRETTA was racing in last position and only battled in the straight to finish some distance from the place-getters.
--Mr Turner had nothing to say.
--PENALTY SUBMISSIONS:
--Mr Coles produced Mr Turner’s record which showed four charges in the last four years. He submitted a fine of $250 - $350 would be appropriate.
--Mr Turner said a fine would be preferable to a suspension.
--PENALTY:
--The Committee considered these submissions and before imposing penalty told Mr Turner they were concerned at his record and that he was using the whip excessively when the horse was well beaten. Accordingly we impose a fine of $350.
