Ms Burdan’s Apprentice Jockey’s Licence was suspended from the end of racing on 8 August up to the cessation of all racing on 22 August 2020.
Facts:
Following the running of Race 8 (Moemoea Park 1200), Information No. A12924 was filed with the Judicial Committee. It was alleged by the Informant, that Ms Burdan allowed her mount FLEURGUNDY to shift in near the 900m when insufficiently clear of SAINT CROIX, RUKUHIA and PALAMEDES which were all hampered and crowded.
Ms Burdan acknowledged that she understood the Rule, the Charge and confirmed that she admitted the breach.
Mr Williamson showed film replays and identified all horses named on the Information.
He submitted that Ms Burdan let her mount shift in when not clear which saw the three runners to her inside being crowded and hampered to varying degrees. Mr Williamson said that a mitigating factor could be that when Ms Burdan first shifted, she was almost clear, but that it appeared that the runner to her inside (SAINT CROIX) was over-racing and had improved up on the inside.
Mr Harris said that Mr Williamson had summed it up well, and added that Ms Burdan is relatively inexperienced, and that the Rider of SAINT CROIX (Mr Alam) was having difficulty controlling his mount. He further said that CHIARETTA racing on the inside (adjacent to the running rail) may have shifted out.
Ms Burdan said that she understood what had happened, and added that the leading horse had shifted in when clear and that her horse was inclined to follow its line. She concluded by saying that she had misjudged the situation.
Submissions for Penalty:
Mr Jones said that Ms Burdan had a very good record with only one suspension in 12 months for careless riding, that being on 14 March 2020. He placed the carelessness in the low to mid-range category.
Mr Harris asked that Ms Burdan’s inexperience be taken into account along with the mitigating factor.
Ms Burdan said that she was sorry for what had happened. Discussions then took place as to when a suspension could commence.

The film evidence showed that Ms Burdan did allow her mount to shift in near the 900m when not the required distance clear (2 lengths), with the runners to her inside being crowded and hampered. It was also evident that as soon as Ms Burdan realised what had occurred to her inside, she immediately came off and released the pressure. It was also noted that the horse racing to her inside was over-racing and had improved quickly. For those reasons the carelessness was placed in the low-range category by the Committee.
The JCA Penalty Guide starting point for such carelessness is a suspension of 6 Riding Days.
After considering all matters relevant to penalty, it was determined that a 5 Riding Day Suspension was a suitable penalty for the breach.
