Following the running of race 2, The Phill Cataldo Bloodstock 2YO, information 41026 was filed by Stipendiary Steward Mr R Neal in which he sought a ruling under rule 632 “in that “THE MUFFIN MAM” did not obtain a fair start”.

--

Rule 632 states:-

--

 

--

“If, in the opinion of the judicial committee, a horse does not finish in the first three placings was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away of its own accord), the Judicial Committee may declare such horse to be a non-runner”

Mr Neal showed the film from an overhead camera at the start.  The film showed the gate of THE MUFFIN MAN, which was drawn 5 in the field of 10, was closed when all the other horses in the race had left the gates.  He said the chances of THE MUFFIN MAN were severely affected and the horse was denied a chance of properly participating in the 1000m race.

Mr Ho said that when his gate did open he was approximately 5 lengths behind the second to last horse and thought a false start would be declared and didn’t initially push his horse that hard.  On realising a false start was not declared he carried on racing but was last throughout.

Mr Phillips produced the gate rubber from stall 5 that had broken when the gates opened.  He said the rubber was in good condition and it breaking was just one of those unfortunate things.  He further said that he had contemplated calling a false start but given the race was for 2 year olds over 1000m he decided not to as it was likely many of the other 9 runners would have proved difficult to pull up.

After viewing the film the Committee agrees that THE MUFFIN MAN was denied a fair start and prevented from taking an effective part in the race owing to the mechanical failure of the starting stalls which materially prejudiced the chances of the horse.  Accordingly THE MUFFIN MAN is declared a non-runner in race 2.
