As Mr Bradley admitted the breach, it was deemed to be proved.
Penalty:
Mr Bradley’s license is suspended from the close of racing on Saturday January 16th, 2021 up to and including racing on Saturday January 30th, 2021 (6 days). In addition, he is fined the sum of $600.
Facts:
Following the running of Race 1 an Information was lodged by Mr Goodwin alleging a breach of Rule 638 (1) (d) in that D Bradley MAROTIRI BELLE permitted his mount to shift in near the 1100 metres when not sufficiently clear of RAINBOW DUNDEE which clipped a heel and blundered.
Mr Goodwin used the head-on video of the start to identify the runners involved and highlight the incident. Mr Bradley (MAROTIRI BELLE) began from barrier 8 with RAINBOW DUNDEE, ridden by Danielle Hirini, to his immediate inside in barrier 7.
Soon after the start Mr Bradley angled his mount in when not clear of RAINBOW DUNDEE whom he contacted and directed inwards. This inward movement caused Rider Mrs Allpress to take evasive action on SOLA POWER. Also affected but to a lesser degree was THE HOTTIE who was inside of SOLA POWER. Mr Goodwin showed how after Ms Hirini was checked she clipped the heels of MAROTIRI BELLE and blundered when Mr Bradley eased the pace.
All three video angles were shown.
Mr Bradley admitted the breach but explained to the Committee that MAROTIRI BELLE is a very aggressive mare who usually runs hard in her races and leads. GOT THE CALL jumped away quickly for Rider Mereana Hudson and was in front. Mr Bradley thought he would get into second position but as he was doing so Ms Hudson was also easing and, in his opinion, this contributed to the pressure back in the field. While admitting he caused interference to RAINBOW DUNDEE, he did not believe his actions caused the interference to SOLA POWER or THE HOTTIE.
Mr Goodwin said when Mrs Allpress was questioned in relation to the incident, she explained it was Ms Hirini she was calling to for more room. Mr Goodwin said it was Mr Bradley who was responsible for directing RAINBOW DUNDEE inwards onto Mrs Allpress, not Ms Hudson.

Mr Goodwin presented Mr Bradley’s riding record which showed 1 breach of the Careless Riding Rule within the last 12 months:
5/9/20--Wanganui-3 days suspension
Mr Goodwin described today’s breach as above midrange and submitted that a penalty in line with the updated Guidelines was appropriate.
Mr Bradley advised the Committee of riding engagements through until next Saturday at Trentham. He made a strong plea for a 2-day suspension only but with a larger fine to enable him to ride at Trentham on January 23rd. Mr Bradley said this is not something he normally does but he is concerned that with 3 race meetings scheduled for the 23rd there will be insufficient Riders available.
Reasons for Penalty:
After carefully considering all submissions the Committee explained to Mr Bradley that we could not accommodate his wish for a 2-day suspension and a fine due to the level of the breach.
It was our opinion that Mr Bradley’s carelessness was above midrange. We based this on the fact that he moved inwards 3-4 horse widths when never the required distance clear of RAINBOW DUNDEE, and at no stage did he attempt to correct his line of running. As a result, Ms Hirini suffered a relatively severe check and the concertina effect affected two further runners inside of her mount. Safety in racing is paramount and Ms Hirini was fortunate not to fall. Her position in the middle of the field allowed her no options to get out of the difficulty brought about by Mr Bradley’s careless riding. Neither the films nor the evidence satisfied us that Ms Hudson’s riding played a part in the incident.
The Penalty Guide for Judicial Committees provides the following starting points for Careless Riding breaches:
Low range:- $250 + 4 days suspension
Mid-range:- $500 + 5 days suspension
High range:- 9 days suspension
Having placed Mr Bradley’s carelessness above midrange we adopted a starting point of 7 days and discounted this by one day for his good riding record.
