As Mr Hannam admitted the breach the charge was found to be proved.

Facts:
Mr Goodwin lodged an information with the Judicial Committee alleging a breach of Rule 638 (3) (b) in that Mr Hannam used his whip excessively prior to the 200 metres when riding AUTHENTIC PADDY. Mr Hannam acknowledged he understood the rule and confirmed his admission of the breach.
The rear view and side-on videos were shown with Mr Goodwin counting twelve to thirteen strikes of the whip prior to the 200 metres. He said this was a clear breach of the rules as Mr Hannam had used the whip without respite.
Mr Hannam had no dispute with the interpretation of the videos.
Submissions for Penalty:
Mr Goodwin said Mr Hannam’s riding record showed four previous charges of excessive use of the whip since July 2013 (there were in fact five with there being two charges in one day on 27/7/13). Three of those breaches occurred in July of last year and more recently the following 2 charges:

17/5/14 $250
Mr Goodwin said there was a significant gap between last year’s charges and this year’s charges however the Stewards’ submission was for a monetary penalty of between $250 and $400.
Mr Hannam was invited to make submissions on penalty but told the committee it was self-explanatory. When asked by the committee if he wished to make comment on his record he said that while ”it (his record) doesn’t sound that great” he does get lots of rides e.g. he was riding yesterday at Ashburton. The chairman commented that all his breaches had occurred during the winter months and Mr Hannam admitted that while it was a grind that was not an excuse.
Reasons for Penalty:
The committee notes that the starting point for penalty for a second breach of the rules within a year, as provided in the penalty guide, is a fine of $500 or a 2 riding day’s suspension. Neither Mr Goodwin nor Mr Hannam put forward submissions for a suspension.
Mr Hannam’s record under this rule is an aggravating factor with today’s charge his third in four months however this has to be balanced with the large number of rides he has. (The NZTR website has Mr Hannam’s total number of rides to date this season at 568). It must also be noted that Mr Hannam had an 8 month period where he did not breach the rule.
We also had regard to the severity of the breach, in particular the manner in which Mr Hannam used the whip and the number of strikes over the guidelines. We did not consider today’s breach to be at the high end.
Taking into account Mr Hannam’s admission of the breach and other recent penalties it was our opinion that a monetary penalty of $450 was an appropriate penalty.
