Following the running of Race 1 an information was filed by Stipendiary Steward Mr Neal alleging Ms Davies presented a horse to race in gear which was in an unsound condition.

Rule 612. A person must use sound and suitable gear on a horse.  Was read.

--

Ms Davies admitted this breach of the rule and confirmed this at the hearing, and she understood the charge and the rule it was laid under.

--

Mr Neal presented the composite bridle of leather and synthetic used by Ms Davies on “Howstunnings That”, where the leather cheek strap of some age has broken off and the stewards deem the gear to be of poor condition and unsound to be used on a racehorse.

--

The committee inspected the gear and concur with the stewards the poor condition the leather was in.

--

As Ms Davies has admitted the charge the committee has to adjudicate on the penalty only.

--

Penalty submissions.

--

Mr Neal confirmed he had no record of Ms Davies offending previously but was concerned with the safety of riders due to unsafe gear and recommended a fine in the range of $150 to $250.

--

Ms Davies was very apologetic and confirmed she had not been charged in 20 years involved in the industry.

--

The committee in reaching their decision on penalty have considered the evidence presented of gear in poor condition, that Ms Davies did admit the breach, but are concerned with the safety factor involved.
