As Mr Holmes admitted the breach the charge was found to be proved.

Penalty:

Taking into account all of the submissions we have fined Mr Holmes the sum of $400.

Facts:

Mr Goodwin lodged an information with the Judicial Committee alleging a breach of Rule 330 (3) (c) in that P Holmes was unable to make the contracted weight on GLENGOYNE.

Mr Holmes accepted the ride on GLENGOYNE at a weight of 57kgs but upon weighing out for race 1 found himself unable to make this weight. Mr Holmes had weighed himself prior to the races on his own personal set of scales which indicated he would be at the correct weight. Mr Bateup informed Mr Goodwin who then arranged for Mr Bradley to be the replacement rider on GLENGOYNE. The change was notified to the betting public.

Submissions for Penalty:

Mr Goodwin said Mr Holmes had clearly been struggling with his weight because 57kgs for a jockey is not light. His most recent breach at Matamata was for a 54kg ride. Mr Holmes’ record of overweight breaches this year is as follows:

Mr Goodwin submitted that a monetary penalty of not less than $225 be imposed.

Mr Holmes admitted struggling with his weight in winter, more so than during the summer months, but also believed his scales might be faulty. He suggested that the moving around as he travelled might cause them to give inaccurate readings as they were obviously wrong this morning. His agent Mr Curnow, books all his rides and in the winter he can normally ride at 56kgs. The Committee asked Mr Holmes why he accepted a ride at 54kgs at Matamata last week. Mr Holmes' response was because it was a horse he always rode and he thought he could make the weight.

Reasons for Penalty:

In setting penalty the Committee took into account Mr Holmes’ record, which can only be described as fair, and in particular the weight of 57kgs that he failed to make today. It was only 7 days ago that Mr Holmes accepted a ride at 54kgs (and weighed in just over 55kgs). In one week he has gained 2kgs which we believe indicates a lack of commitment on his part. Whatever measures Mr Holmes is taking to control his weight are not working and previous penalties have not served as a deterrent. It was fortunate that there was a suitable replacement rider available at such short notice.
