As Mr Weatherley admitted the breach, the charge was deemed proved.

Accordingly, Mr Weatherley is fined the sum of $400.

Facts:

Following Race 7, Stipendiary Steward Mr Goodwin lodged an Information with the Judicial Committee alleging a breach of Rule 638(3)(b)(ii) in that S Weatherley used his whip excessively in the home straight on SAMPSON.

At the outset of the hearing, Mr Weatherley confirmed he understood the Rule and that he admitted the breach.

Ms Clapperton was available to assist.

Mr Goodwin showed on the video where Mr Weatherley struck his mount a conservative 8 times before the 100m mark. This is three over the guidelines.

Mr Weatherley was satisfied with the number of strikes as counted by the Stewards.

Submissions for Penalty:

Mr Goodwin had Mr Weatherley confirm that this was his first breach of the whip rule since all riders’ records were reset with the implementation of the new guidelines on October 7th 2019. He said the Stewards were seeking a minimal fine for today’s breach.

Mr Weatherly explained that he simply misjudged the number of strikes, his mount was in contention to win, and he erred in his judgement.

Reasons for Penalty:

The Penalty Guide for Judicial Committees provides the following starting points for breaches of Rule 638(3)(b)(ii):
1st breach - $300
2nd breach - $500
3rd breach - suspension

The Committee considered all submissions and as this was Mr Weatherley’s first breach of the whip rule we adopted a starting point of $300. In our opinion, a modest increase was appropriate due to the fact that SAMPSON ran second in the race and the breach occurred in the feature race of the day, the Listed Marton Cup.
