As Ms Goldsbury admitted the breach we found the charge proved.

Penalty:

Ms Goldsbury is suspended from the close of racing on Friday March 10th up to and including racing on Thursday March 23rd.The days included in this period are:

Facts:

Following the running of Race 8 (Power Farming Handicap), an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1) (d) in that “R Goldsbury allowed her mount to shift out when not sufficiently clear of NEWSTEAD passing the 400metres”.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Ms Goldsbury confirmed to the Committee that she understood the charge and that she admitted the breach. Ms Goldsbury is an apprentice rider therefore Mr Kane Smith was present to assist and support as necessary.

Mr Balcombe used the films to identify the individual runners involved and Mr Goodwin explained the reason for the careless riding charge. He said that Ms Goldsbury was racing in a position adjacent to the running rail with Mrs Allpress (NEWSTEAD) behind and to her outside and Mr Bradley (HARE BAWL) wider out. At the 400m mark Ms Goldsbury elected to angle her mount outwards when not the required distance clear of NEWSTEAD causing a check to that runner. Mr Goodwin said Mr Bradley may have shifted in slightly but this had no bearing on the incident.

Ms Goldsbury said she was improving on the rail and moved off to make her run. She thought that Mrs Allpress was three wide but accepted that she caused interference to NEWSTEAD. Mr Smith said that Mr Goodwin had summed up the situation fairly.

Submissions for Penalty:

Mr Goodwin submitted that a term of suspension was an appropriate penalty. He said Ms Goldsbury had a clear record with no previous breaches within the last 12 months. The Stewards placed the degree of carelessness in the lower range.

Ms Goldsbury said she believed the incident was at the lower end and in case of suspension she advised of riding commitments next Friday at Otaki.

Mr Smith raised the valid point that there are approximately 13 fewer race days in the Central Districts region this season resulting in fewer opportunities for CD only based riders.

Reasons for Penalty:

The Committee advised Ms Goldsbury of the five day starting point for careless riding charges as outlined in the Penalty Guide for Judicial Committees. We identified no aggravating factors that would require an uplift in penalty. The Stewards did not believe that the interference affected any of the final placings. We assessed the level of carelessness to be low end and Ms Goldsbury simply made an error of judgement in allowing her mount to move out a horse width further than required.

Mitigating factors were Ms Goldsbury’s clear record, her admission of the breach and the low level of carelessness for which we have allowed a 2 day reduction imposing a penalty of three days suspension.
