As Ms Dravitzki admitted the breach we found the charge proved.

Penalty:

Ms Dravitzki is therefore suspended from the close of racing on Saturday March 2nd up to and including racing on Saturday March 9th.  Race days in this period are:

6/3/13                   Auckland
8/3/13                   Otaki
9/3/13                   Auckland

Charge:

Following the running of Race 3, an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1) (d) in that M Dravitzki (QUEEN OF EXCUSES) allowed her mount to shift out over the final stages causing interference to WISH YOU WERE HERE.

Facts:

The head-on film showed Ms Dravitzki riding her horse with vigour in the run to the finish where she finished in second place. Racing on her outside was Ms Morgan who finished in third place. Prior to the post Ms Dravitzki’s mount moved outwards and made contact with the mount of Ms Morgan. Ms Dravitzki did not put the whip away and attempt to straighten but hit her horse again despite it shifting out under pressure. A protest was lodged by the third placed horse against Ms Dravitzki but it was unsuccessful.

Submissions for Penalty:

Mr Goodwin considered the carelessness to be over midrange and submitted that a period of suspension was an appropriate penalty. He asked Ms Dravitzki to confirm that her record showed suspensions on:

 20/12/12 - 4 days

 11/9/12 - 3 days
Mr Gray asked the committee to consider Ms Dravitzki’s good riding record with only 2 suspensions in 200 rides and also to note that the placings were not changed in the protest that was lodged after the race. He requested leniency saying that young apprentice riders did not learn by sitting out suspensions in the grandstand.

Reasons for Penalty:

The committee took into account all of the submissions and adopted as a starting point, a period of five days suspension. We assessed the degree of carelessness to be mid range as Ms Dravitzki failed to stop riding and take corrective action when her mount rolled outwards. We did not consider the fact that the protest was dismissed to be a mitigating factor. That was a separate hearing focusing only on the chances and placings of the horses involved. We took into account Ms Dravitzki’s early admission of the breach and her very good riding record giving her a discount of one day.  We were satisfied, by the evidence produced, that Ms Dravitzki rides regularly across the North Island.
