Decision: Following the running of Race 6, the Sunshine Books Maiden over 1400 metres, Mr C. Lammas lodged a protest under Rule 876 (1) alleging that Pinzy’s Chance or its rider placed 1st by the judge caused interference to Cancan placed 2nd by the judge.

Cancan was represented by the trainer Mr K. Gray and rider Mr C. Lammas and the connections of Pinzy’s Chance were trainer Ms. L. Latta and rider Mr D. Bradley.

Mr Lammas told the committee that he was racing one off the fence in the home straight level with Mr Bradley ( Pinzey’s Chance) on his inside.  Using the head-on video he alleged that Mr Bradley riding Cancan pushed his mount Pinzey’s Chance out wider and wider on the track.  He said that his horse was only little, was wearing blinkers and he believed that his line of running had been dictated by the actions of Mr Bradley.

Mr Gray agreed with Mr Lammas’s interpretation of the final stages of the race urging the committee to take note that his horse had been carried over extra ground and was only beaten by half a head.

Mr Bradley said that both horses raced side by side equally down the straight.  He said that there was no contact between them and that both were ridden out fully to the line.  Mr Gray’s horse had every chance to win the race but Pinzey’s Chance was the better horse on the day and fought the hardest.

Ms.Latta said that Cancan had rolled inwards a little as Pinzey’s Chance moved out however no rider was forced to stop riding.

Mr Goodwin, for the Stipendiary Stewards, said that Mr Bradley did move out and make brief contact with Cancan however it was his opinion that both horses moved out under pressure over the final stages of the race.

Rule 876 (1) states:

--

 

--

 If a placed horse or its Rider causes interference within the meaning of this Rule 876 to another placed horse, and the Judicial Committee is of the opinion that the horse interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.

--

After listening to all the evidence and viewing the films the committee accepts that there was movement outwards across the track by both horses.

--

We were not convinced however that this movement was caused entirely by Pinzey’s Chance (D. Bradley).  It was our opinion that Cancan moved outwards independently while under pressure and any slight contact between the two horses did not sufficiently disadvantage Cancan for a relegation to occur.

The protest was dismissed and placings allowed to stand as called by the judge.
