As Mr Tanaka admitted the breach we found the charge proved.

Mr Tanaka’s license is suspended from the close of racing on Saturday March 3rd up to and including racing on Thursday March 15th.
Facts:
Following the running of Race 1 (Tui- Backing Winners since 1889 Maiden) an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1) (d) in that Jockey M Tanaka allowed his mount to shift outwards when not clear of MARJOLET which was hampered near the 200m.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Tanaka confirmed to the Committee that he understood the charge and that he admitted the breach. His agent, Mr A Neill, was also present throughout the hearing.
Mr Goodwin outlined the incident using the head-on film. Early in the run home Mr Tanaka was trying to establish a run to the outside of CEAD MILE FAILTE ridden by Ms R Myers. As he angled outwards, from a position behind Ms Myers, he pushed the horse to his outside (MARJOLET, A Collett) wider. Mr Goodwin said while that runner was not checked it was jostled and forced over extra ground. MARJOLET then ran home strongly and the Stewards considered lodging a protest against Mr Tanaka, but the margins were considered to be too great.
Mr Tanaka told the Committee that as he moved out from behind Ms Myers he made contact with Ms Collett. He described this incident as a “small bump”. He then began to use the stick, with the result being that his horse ran out further, pushing Ms Collett even wider. Mr Tanaka admitted he should have taken corrective action earlier than he did.
Submissions for Penalty:
Mr Goodwin produced Mr Tanaka’s riding record which showed three suspensions for careless riding in the last 12 months. These were:

13/5/17 4 days
4/3/17 5 days
Mr Goodwin described Mr Tanaka’s record as good and the degree of carelessness as below mid-range. He said that MARJOLET was not checked in the incident, only badly jostled and that this type of riding was out of character for Mr Tanaka. The stewards’ submission was for a term of suspension in line with the degree of carelessness.
Mr Tanaka had nothing to say regarding penalty. His agent, Mr Neill, advised that he had no pending commitments after Saturday at Ellerslie, therefore any suspension could begin after racing tomorrow.
Reasons for Penalty:
The Committee took a different view to that of the Stewards in assessing the degree of carelessness. Mr Tanaka moved outwards approximately 3 horse- widths while continuing to lay on and hamper Ms Collett’s mount MARJOLET. He continued to ride with vigour; at no stage did he stop riding and straighten his mount. Mr Tanaka ran 2nd and Ms Collett 5th. The only reason the Stewards did not lodge a protest was the margin between the two horses at the finish. It is highly possible that Ms Collett would have finished in a higher placing with an uninterrupted run.
We placed the degree of carelessness as at least midrange and adopted a starting point of 8 days, as outlined in the Penalty Guide for Judicial Committees.
Statistics show Mr Tanaka has had three careless riding charges in the last year but only one within the last 9 months. Considering the number of rides he has had (267 to date for the 2017/18 season) we considered his record to be a good one. We have allowed a one day discount for his record and his admission of the breach.
An appropriate penalty is a suspension of seven days.
