DECISION AND REASON:
--Following the running of Race 9, the Nufarm Handicap, CW Johnson, the rider of WALNUT was charged with a breach of Rule 858(1)(b). It was alleged that Mr Johnson weighed in over his weighed out weight.
--Mr Johnson admitted the breach.
--Mr Oatham stated that Mr Johnson had weighed out 0.5kgs over the carded weight, however, when weighing in this had increased to 1.2kgs.
--Penalty:
--It was Mr Oatham's submission that Mr Johnson is fined the sum of $200 and Mr Johnson confirmed to the committee that he accepted this penalty.
--Therefore we find that Mr Johnson be fined $200, which is a penalty in keeping for similar breaches of Rule 858(1)(b).
