As Mr Singh admitted the breach, it was found proved by the Committee.

Penalty:

Accordingly, Mr Singh’s license is suspended from the close of racing on Saturday, September 21st 2019 up to and including racing on Saturday, September 28th 2019.

Facts:

Following the running of Race 1 (Pilet Contracting/Pioneer Seeds Maiden 1400), an Information was lodged by Mr Goodwin alleging a breach of Rule 638 (1) (d) in that M Singh angled his mount ROCK WITH CHOUX in when not clear of HARRY HARRISON which was checked near the 1250 metres.

At the outset of the hearing, Mr Singh confirmed he understood the rule and that he admitted the breach.

The incident occurred soon after the start of the race, and Mr Goodwin had Mr Balcombe identify the two horses using the head-on video. Mr Singh (ROCK WITH CHOUX) started from the no. 5 barrier and HARRY HARRISON from barrier no. 2. Soon after the start Ms O’Beirne had HARRY HARRISON positioned on the rail when Mr Singh angled across in front of her when not sufficiently clear. Ms O’Beirne anticipated Mr Singh coming across and took corrective action. While it had been her intention to lead, Mr Singh’s actions prevented her from doing so.

Submissions for Penalty:

Mr Goodwin said Mr Singh had a very good record. He had had 342 rides over the last 12 months and incurred only two suspensions, both for low range careless riding:

Mr Goodwin described today’s breach as again within the low-range. He said that Ms O’Beirne’s mount was pulling hard and Mr Singh angling across had made things difficult for her. It was the Stewards’ submission that a suspension was an appropriate penalty.

Mr Singh was invited to make submissions on penalty. He told the Committee that he had looked to his inside while crossing and believed he was clear of HARRY HARRISON. On viewing the video footage, he conceded that he wasn’t the required 2 lengths clear. Mr Singh said HARRY HARRISON was a difficult ride for Ms O’Beirne.

Reasons for Penalty:

The Committee considered all submissions. HARRY HARRISON jumped from barrier 2 and was soon on the rail eager to run and pulling hard for Ms O’Beirne. The videos showed Mr Singh angling in towards the fence from barrier 5 and looking to his inside as he came across. He was aware of Ms O’Beirne’s position but believed he was sufficiently clear of her at that point. Ms O’Beirne was forced to pull back instead of taking the lead, but HARRY HARRISON was proving a challenging ride and was difficult to restrain.

It was the opinion of the Committee that the incident could be classed as low-end careless riding. We adopted a starting point of 6 days suspension. In mitigation, we considered Mr Singh’s ready admission of the breach and his very good record. There were no aggravating factors.

It was our opinion that a 5-day suspension was an appropriate penalty.

Mr Singh advised of riding commitments through until after next Saturday.
