As Mr Tinsley admitted the breach, the charge was found to be proved.

Charge:

Mr Goodwin lodged an information with the Judicial Committee alleging a breach of Rule 330 (3) (c), in that H Tinsley was unable to make the weight for CASINO (Race 1), ARE YOU DEVIOUS in Race 5 and BLOOD BROTHER in Race 8.

Facts:

Mr Tinsley told the committee that he was reluctant to take rides at 55.5kgs this week, but due to it being a local Premier meeting and being assured by his agent, Mr Neil, that he was allowed to ride a half kilo over, he did accept three rides at that weight. Today, instead of being 56kgs, he was 56.5kgs - one kilogram over the carded weight.

Submissions for Penalty:

Mr Goodwin said that Mr Tinsley had inconvenienced the trainers of three horses, however replacement riders of equal calibre to Mr Tinsley had been found for each horse, and the trainers were happy with these riders. In regard to Mr Tinsley’s record, he had two recent breaches dealt with under the minor infringement system. Mr Goodwin said that Mr Tinsley is very conscientious about his weight, but unfortunately he walks a fine line. His submission was for a fine of not less than $300.

Mr Tinsley said that he has been having trouble recently losing that “last half kilo”, and weather conditions yesterday prevented him from working outside. Despite trying everything, that last half kilo would not budge. He said that his weight does not balloon up and down; it is always only half a kilo he has trouble with.

Reasons for Penalty:

The committee considered all of the submissions. Mitigating factors for Mr Tinsley were his admission of the breach, his forthrightness before the committee and his record. Despite having had two recent breaches of Rule 330(3) (c), he has not appeared on this charge within the previous 12 months. We believe Mr Tinsley is genuine in his attempt to keep his weight under control, but recent circumstances have seen this become more difficult for him. The committee told Mr Tinsley, that had only one horse been affected, he would have been facing a lesser monetary penalty, however an aggravating feature in this instance, is the fact that three horses and three lots of connections have been affected, with one of those being in the Listed race of the day. It was fortunate for Mr Tinsley and his agent that there were appropriate replacement riders available.
