Facts:

Following Race 2, The Rural Fuel Premier, a protest was lodged pursuant to Rule 642(1) by Mrs L Allpress alleging that horse number 1 or it'S rider placed 2nd by the Judge interfered with the chances of horse number 5 placed 3rd by the JUDGE.

The information alleged interference by VINCENT STREET against QUEEN OF THE CASTLE in the home straight.

Judges placings were:

1st - CHOICE BRO
2nd - VINCENT STREET
3rd - QUEEN OF THE CASTLE
4th - BELLAPIN
5th - SCARLETT O’HARA

The official margin between 2nd and 3rd was a short head.

Submissions for Decision:

Mrs Allpress told the committee that just prior to the 200 metre mark she was coming up on the outside of Ms Myers mount to the point where they were almost adjacent to each other. Using the head-on video she showed how Ms Myers rolled outwards on VINCENT STREET causing interference to her horse, QUEEN OF THE CASTLE. Mrs Allpress had the video put on pause prior to the alleged interference to demonstrate a wide gap between the two horses. With the video running at slow speed Mrs Allpress showed how Ms Myers rolled out onto her with the back end of VINCENT STREET coming into contact with the shoulder of QUEEN OF THE CASTLE. Mrs Allpress had to pull her mount sideways, rebalance and continue riding. In addition, a few strides after the interference when racing in close quarters, QUEEN OF THE CASTLE was struck across the face by the whip of Ms Myers and could be seen to flick her head to the side and hesitate as a result. Mrs Allpress said the two incidents prevented her from gaining a higher placing and taking into account the short head margin she was sure that had she had a clear run to the line she would have beaten VINCENT STREET.

Mr Crutchley said the side on video clearly showed how QUEEN OF THE CASTLE went back a length as a result of the interference and went back again after being struck with the whip. With the margin at the finish he was convinced his horse would have beaten VINCENT STREET if it had not been impeded.

Ms Myers disagreed totally and said she did not believe QUEEN OF THE CASTLE lost any momentum at all in the incident or that Mrs Allpress had been forced to stop riding. She said following the interference Mrs Allpress had 200 metres to get past her and it was only when the eventual winner came from behind that both horses fought back close to the line.

Mr Hillis agreed with Ms Myers and said he could not see where Mrs Allpress lost ground.

For the Stewards Mr Neal said it was obvious that prior to the incident Mrs Alpress was riding QUEEN OF THE CASTLE out with vigour but when the interference took place she did have to stop riding and as a result lost momentum. He also said the strike across the face with the whip impeded the finishing run of Mrs Allpress’s mount. In his opinion the protest had some merit.

Reasons for Decision:

In coming to a decision the committee carefully considered all of the evidence presented. We revisited the four videos shown during the hearing; these being the head-on, side-on, rear view and back straight camera angles. We were satisfied that QUEEN OF THE CASTLE suffered interference on two occasions. The first incident was a direct result of VINCENT STREET moving outwards and making sharp contact with her just prior to the 200metres. The interference was brief but significant in that QUEEN OF THE CASTLE was pushed off-stride and suffered a loss of momentum. The second incident where QUEEN OF THE CASTLE was hit across the face with the whip was also significant. The head-on film showed how the horse hesitated and turned its head to the right as soon as it was struck. It was the committee’s opinion that these combined incidents caused QUEEN OF THE CASTLE to lose ground at a vital stage of the race.

Taking into account all of these factors in particular the manner in which QUEEN OF THE CASTLE finished the race off and the short head margin between the two horses at the finish we upheld the protest.
