On returning to the enquiry room the parties were advised that a full written decision would be available on the JCA website as soon as possible. They were told the protest was dismissed and the placings as called by the Judge (as detailed above) were confirmed. The authorisation to pay all dividends was given.
Facts:
Following the running of race 8, information 31175 was filed by Licensed Jockey Mr D Bradley under rule 642 (1). The information stated that “I, D Bradley, allege that “Monkey Briscoe” or its rider placed first by the judge interfered with the chances of “Margrethe” placed second by the judge. The interference occurred over the final stages”.
Rule 642 (1) states:-
“If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”

The official placings in the 5 horse race were:-
1st - 2 Monkey Briscoe
2nd - 7 Margrethe
3rd - 3 Dubhdara

The official margin between 1st and 2nd was a nose.
Submissions for Decision:
Mr Bradley used the head on and rear on views of the film to show he was racing on the inside of “Monkey Briscoe” during the final stages of the race with both horses racing in the middle of the track. He said as he started to slightly drift in Ms Whelan had followed him and had made contact on a couple of occasions and also crowded him over the final 3 strides. He said when the interference took place he was making a good challenge, had the upper hand but was unable to fully ride “Margrethe” out to the finish. He said the close margin of the race meant that had the interference not occurred he would have had a straight run to the line and won the race. To a question from the Committee Mr Bradley said that when bumped by “Monkey Briscoe” his horse had moved in at least 1.5 to 2 horse widths which had forced him into the worst of the ground.
Stipendiary Steward Mr Goodwin was asked to show the side on film from where the alleged contact took place and this showed that it happened approximately 10 strides from the post.
To a question from the Committee as to whether he had stopped riding “Margrethe” out Mr Bradley said he had been hitting her on the neck all the way down the straight and as the crowding increased close to the post it stopped him being able to drive “Margrethe” out to the line.
Mrs Zimmerman said she agreed with everything Mr Bradley had said and that the film clearly showed “Margrethe” being crowded and Mr Bradley being unable to use his whip “to the full extent” in the final stages of the race.
Mrs Egan agreed the horses had made contact, however, Mr Bradley had not stopped riding his horse at any time and had been able to use his whip all the way to the finish.
Ms Whelan said she believed slight contact had been made about 5 strides from the post but did not think Mr Bradley had stopped riding his horse out.
Stipendiary Steward Mr R Neal said over the concluding stages of the race there had been significant crowding to Mr Bradley from Ms Whelan on his outside. He said over the final 100 metres there had been on at least 2 occasions when the horses had touched. He said Mr Bradley had said he was restricted in his ability to ride out over the closing stages but on the other hand the film showed he had not had to sit up at any stage over the final 150 metres and more particularly the final 50 metres. He said that the impact of any bump a horse gets is subjective but any bump a horse gets when racing on wet ground can have an effect on their balance and ability to finish the race off. He said it was a difficult protest given the narrow winning margin and the fact that Ms Whelan had followed Mr Bradley in as he moved inwards to the rail.

The Committee has reviewed the films of the incident and listened carefully to the submissions of all those present. Halfway down the home straight “Margrethe” and “Monkey Briscoe” were racing down the middle of the track. Both horses then started to move slightly inwards and in doing so “Monkey Briscoe” made contact with “Margrethe” on 2 occasions. In the final 100 metres of the race whilst Mr Bradley was slightly restricted in his whipping action he was still able to drive his horse forward and strike “Margrethe” on the neck in the way he had been doing all the way down the straight. At no stage do we believe he had to stop riding Margrethe and we do not believe the contact he received moved him inwards the 1.5 to 2 horse widths he said it did. Notwithstanding the narrow winning margin we are not completely satisfied that had contact not happened between “Monkey Briscoe” and “Margrethe” that “Margrethe” would have won the race and accordingly the protest is dismissed.
